He may be acting.

But, Pence acted in a Totally complicit manner to uphold the lawlessness at the federal level against the Constitution, and to uphold the lawlessness at the state level against state laws of election.

He appears to need a Pardon. I don’t know how he can lawfully be backed out of what he’s done, myself. Idk.

If she gives it up, it becomes 50-47-2 (50-49) for a short period of time with Mitch still as Majority leader and Pence as tie-breaker.
Better she gives it up closer to noon 01/20/2021 - then Padilla gets sworn in to her seat around the same time, then Schumer is Majority leader and Kamala is the tie-breaker.

What damage could really be done if she decides to give it up now?

I’m sure D.C. has been well-swept by the white hats for nuclear material. I’d be more concerned about something like this at a state capital.
