LEGAL FILING — Mike Pence refused to sign on to plan to overturn election…

Lawyers representing Louie Gohmert and a group of Arizona Republicans disclosed in a court filing Tuesday that Vice President Pence rejected their request to join their attempt to block electors.

Gohmert and 11 GOP “alternate” electors from Arizona filed suit against Pence on Monday in an attempt to argue that the vice president has sole authority to determine which presidential electors Congress will count when it certifies the results of the election. The suit essentially asks the court to grant Pence the authority on Jan. 6 to overrule the results in swing states such as Arizona and have Congress count only pro-Trump electors.

In new court filings made public Tuesday, the plaintiffs disclosed that they had reached out to Pence before filing their suit in an attempt to join forces but that their talks did not reach any kind of agreement.

“In the teleconference, Plaintiffs’ counsel made a meaningful attempt to resolve the underlying legal issues by agreement, including advising the Vice President’s counsel that Plaintiffs intended to seek immediate injunctive relief in the event the parties did not agree,” lawyers for Gohmert and the electors said in the filing. “Those discussions were not successful in reaching an agreement and this lawsuit was filed.”

The revelation was made in a filing in which Gohmert’s attorneys sought an expedited schedule for a ruling from U.S. District Judge Jeremy Kernodle of the Eastern District of Texas, a Trump appointee.

The backlash is tens of millions of us who no longer vote Republican if it’s an obvious RINO. We vote a straight Republican downticket and write in whatever conservative coulda got the ticket.

Article 12 takes over if their votes do not agree... on any one challenge.

The Electoral Count Act, which this suit challenges as unconstitutional, but has not previously been challenged for 150 years or so, provides that, unless both houses agree, the electoral votes certified by the state's Governor will be the ones counted.

Pence can just refuse to accept the electors in the seven contested states of Arizona, Georgia, Michigan, New Mexico, Nevada, Pennsylvania, and Wisconsin who have sent dueling slates of electors to D.C. Since they violated Article II, Section 1 of the US Constitution by not following their own state constitutions in conducting their elections, the electors' votes submitted should not be considered because they are illegal.

Each of those states' Supreme Courts held that they did follow their own Constitutions.

The Dems have a plan to block Pence from the chamber and to use a new President Pro Tempore to count the electoral votes. This plan requires the Dems have a,win in Georgia and that Warnock and Ossouf are seated and Romney turns traitor.

The 12th amendment is very clear.

-The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted...

So, get the certificates in there for him to count.

Oh, we may whine and snivel a bit, but we well eventually get on those boxcars headed for the furnaces..

If that is what you believe then by all means, hop right on up there.

The typical prog is very much so "crazy brave" in a mob of 20 / 50 or more.

They have yet to face any form of organized push/payback from a force that was not totally hamstrung by PC engagement rules.

Under a situation comparable to WW II, if "roundups" were to be attempted you will see teams forming all around you comprised of men who will not "get in the boxcars."

In Texas alone there are over 1.3 million combat veterans that can began to come into formations by simply stepping out of the front door and call out up and down the street asking if anyone else feels like NOT "getting in the boxcars."

The total number of active duty US military personnel on the entire planet is 1.4 million, about the same as Texas.

Right here in the middle of Dallas I have spotted 35 to 50 houses on my exercise routes of four square blocks that have a better than 90% chance of being owned by veterans.

Veterans means experience in organization, formations, common skills and terminology, defensive and offensive actions, communications, intel gathering, etc.

That would make a pretty fair platoon of various skills and resources such as food, vehicles, weapons, etc that could very much so handle a four square block area.

So before you are so resigned to hopping into that boxcar you might want to get to know your neighbors.

The way things are going lately, what does a ruling from a partisan court have to do with anything? Nothing seems sacrosanct anymore.

There is all kinds of evidence that has turned up about how the states just did what they wanted without going back through their own state legislatures to do legally.

Pence may have this evidence/information that the court refused to listen to or discounted as "baseless" and can make that judgment himself.

You make a good point.

Also now is not the time to ask for Pence’s head. Big things are brewing in GA and AZ.

Also in the house and probably even in the senate although what we hear about the senate is worrisome.

Things are moving finally, and from very slow to fast.

There is an old saying I have not heard lately to the effect that “One week is a long time in politics.”

And January 6 is one week from today.

If Pence moves too soon, just imagine the outrage from the dims. Congress will be tied in knots over rage and attempts by the crazies to impeach him, or worse.

So he should act as the very last resort in the hope that unfolding events in Trump’s favor will solve the problem.
