White’s Ferry river crossing in Montgomery Co. (MD) ceases operations after court decision

The resolution of a decade’s-long court case brought by a Virginia property owner required White’s Ferry, the historic Potomac River crossing in Poolesville, Maryland, to stop using its traditional landing across the river.

As a result, the ferry operator announced its closure via a Facebook post at 10 a.m., December 28, 2020.

For over two centuries, the ferry has docked on the Virginia side of the river.

A Virginia court ruled the ferry could no longer dock on the opposite shore at White’s Ferry Road in Loudoun County.

In fact, the judge, Stephen E. Sincavage of the Loudoun County Circuit Court awarded damages to the Virginia property owners in excess of $100,000, agreed that White’s Ferry had been trespassing since the end of a licensing agreement in 2004 and through an injunction, prevented White’s Ferry from continuing to use the land. The decision was written in late November.

The owners of the land in Virginia, known as Rockland, complained that White’s Ferry was unlawfully occupying its land. White’s Ferry argued for its right to use the landing due to having customers and business operations on that side of the river for over two centuries.

The case has been postponed and delayed and dismissed throughout the years before the most recent decision, written by Judge Steven E. Sincavage on Nov. 23, 2020...

White’s Ferry was an Icon in Rural MoCo, for those not in the know. The Confederate Soldier statue removed from Rockville, MD courthouse was moved there a few years ago. And the ferry itself was named the Jubal Early - I believe Lee crossed near here on one of his incursions into the United States ...

I’ve never actually used the ferry, but have driven down to it on the VA side a few times. My guess is the landowner and the ferry company will eventually reach an agreement on this.

That’s going to suck for the few people that depended on the ferry. It’s quite a drive to a bridge.

I don’t think so - the ferry operator was fined $100K - heard him on the radio - it’s over.

The time to contest the land usage was 200 years ago. It’s way past 7 years. Probably a corrupt judge. Though these days “corrupt judge” would be redundant.

Rename it the BLM ferry, arrange a few peaceful riots on the MD side, then setup a CHOP zone.

About 30 years ago, my buddy and I were riding our motorcycles and took the ferry to Virginia. The skies opened up and soaked us to the skin. No shelter. We just stood there next to our bikes. Rain stopped when we got to Virginia. That was a great ride.

All of the Potomac river right up to the shore in Virginia is part of the state of Maryland.

“Right of Way” is enshrined in all property law. This is basic miscarriage of justice clearly greased by corruption and payoffs.

Shame...it was always a scenic drive through country roads at slow speed to wind down and enjoy the day. And the peaceful ferry ride always ended too soon reaching the Virginia side where traffic became hellish quickly, even 12-15 years ago.

Beat the other river crossings hands down. Glad that was a quiet secret known to few that lasted as long as it did.

Mosby’s Grey Ghosts are said to have used the crossing

It was named after its owner, Elijah White...

It appears to me that the present ferry owners must not have had the best representation, in court or out, because the state had built a road to the ferry crossing on or before 1795.

There all all sorts of laws regarding permitted use (even by neighbors and other civilians) plus government use plus the powers of eminent domain.

But I guess the paid lease they had for several years negated some of the allowable defenses.
