They WILL and they ARE taking up the case. According to Thomas, there is no option to not take up an Original Jurisdiction case (OJ’s are in the minority, most are appeals).

I think the most likely is sort-of a punt, but not really: Rule that the electors are invalid, and the legislatures must pick new ones.

Then, each of those four legislatures could choose Bitem electors or Trump electors. SCOTUS need not “select” a POTUS.

But, the net effect is - SCOTUS selecting electors, but indirectly. Kind of like sharing the selection.

If they don’t take the case:

1. we do nothing and live under a tyrannical oligarchy
2. we rise up, full on national strike, in the streets until the government falls and we have honest elections again.

If they take the case:

1. rule against us - then see above
2. rule for us - the BLM / Antifa restart mass rioting, or the left takes it quietly, complains constantly, and waits until 2022 to try the same thing again

What happens if Congress refuses to seat electors from PA, GA, MI and WI? What if state legislators refuse to appoint electors?

There are issues raised in the case that the court can decide- most notably the extent of state legislatures control of their federal elections.
I don’t see how they can rule on any evidence though.
Perhaps they can keep cases on those charges from closing down from liberal rulings on “laches” (timeliness) and “standing”.
We desperately need the charges tested in court!

Anyway, the Congress will decide the election. As always.

The outrageous level of fraud perpetrated by the Democrats has mired us all in quicksand.

Law and precedent doesn’t have anything to do with it at this point.

It all depends on five of the nine justices understanding that America ends if the theft is allowed to stand.

This case isn’t about “widespread fraud”. It’s about who has the authority to hold and administer presidential elections. A handful of states used COVID as an excuse to ride roughshod over Constitutional and statutory standards.

First off, the likelihood that the court will hear the case is MUCH higher than many people (including so-called experts) are saying. The full court hasn’t gone on record as to their feelings on the matter, but since the USSC is the only venue for this type of case to be heard, Alito and Thomas are on record as believing that the court MUST accept all such cases. I just read what they wrote on that and they wrote it as part of a dissent on a case between states. The fact that others didn’t chime in and say they felt the same way does NOT in any way mean that others on the court don’t have a similar view. It merely means that they didn’t chime in on the dissent. I expect that there are others on the court (perhaps even a majority) that hold this view.

Either way, original jurisdiction makes this case much more likely to be heard than appeals to the court.

What will happen if the case is not heard is...nothing. It’s over. And really, IMHO, Trump’s challenges in the legal arena end there.

If it is heard, it could go a number of ways. They could hold hearings. They could even have a full blown trial, which is unusual in the USSC, but possible with this rare kind of case. Nobody knows.

But if they take the case, our cause lives on another day. If they don’t, we will immediately know just how hopeless things are, where we stand, and what needs to be done.

After listening to Jay Sekulow’s radio program today, I can tell you that there’s not an easy path to overturning the election in favor of the President.

He said the Supreme Court had multiple options, one of which would be to dismiss the Texas case outright, request more briefings on the issues involved, send it back to the legislatures, which he believes is the most likely outcome.

And depending on what the individual state legislatures decide about their electors, they could retain their original election results or choose other electors.

Jay said that overturning the election is possible, but it’s an “uphill climb.” His words.

He also recommended prayer when someone called and asked what they could do. And that appeal is to the highest court of all.

I thought SCOTUS already “took the case”, just hasn’t ruled on it yet. They gave the four defendant states until yesterday at noon to file file their responses to the suit. If they didn’t “take the case”, why would they do that?

It seems they will be forced to notice all of the procedural shenanigans that these states pulled.

That would lead them to punt back to the states’ legislatures to decide what they want to do.

Get used to disappointment.

Hopefully our “alleged” conservatives on the Court are standing tall, minus Roberts of course, and will hear the case. Problem is the Constitution requires the Electors vote on the first Monday after the second week of December (In 2020 Dec.14) only two more full days away!

Since the Court cant Constitutionally delay the vote they would have to hear verbal arguments over the weekend or very early Monday AM. They could simply accept the written record in the suit without verbal argument and find in favor of Texas et. al. making the votes in question tainted.

If they do that, in effect, they decertify the Presidential election in the the Defendant States and make it impossible for either Presidential candidate to get the 270 Electoral Votes needed. This would begin the Contingent Election process in the House of Representatives when the INCOMMING Congress is seated Jan.18th which will be a one State one vote election and would certainly elect Trump President.

This would mean the Marxist media assembled for victory parties across America to celebrate the Biden/Harris win would choke on their wine and cheese. Those surviving would attack the Supremes with a fury they do not want.

I can only imagine the food fight that is taking place between the factions on the Court with Roberts trying to convince everyone to simply “Decline” and save his cocktail schedule for next year. No explanation would be needed.

With Barret there are enough conservatives to prevail without Roberts if the salvation of their Country is enough to give them the courage needed.

Pray for them.

SCOTUS will either take it or they won’t. What happens if they do? Probably nothing.

What happens if they don’t? Probably nothing.

There isn’t going to be a civil war. There isn’t going to be a resistance. The Dems will swim go left for a while and then they will swing back to center.

Often times on FR lately I get the sense that I am watching a millennial Twitter mob. They feast on the same news over and over. If you do not adhere to the “mob”, they point at you: J’accuse!

Life in America will go on. Pissed off old men will continue to think they was robbed. Eventually, some younger folks will come in and change the dynamic.

Conservative beliefs are stronger than this crap. We will live to fight another day. This is not the end of the Republic. People are too busy living their lives. Take some time and get out of the echo chamber.
