Russell County officials sharing details of the heartbreaking death of 5-year-old Austin Birdseye, the young boy hit and killed by a car Sunday evening on Highway 165 in Fort Mitchell.
According to Sheriff Heath Taylor, 35-year-old Bryan Starr, who's active duty at Ft. Benning, is charged with reckless murder in the case.
Sheriff Taylor says Starr was driving when he pulled over and told the child to get out of the car for being , "Unruly."
"It was raining at the time and it was, obviously at 8 o'clock at night, dark," said Taylor.
Starr reportedly told officials he lost sight of Austin until he saw cars stopped in the road.
"As it turns out, Dustin walked out into 165 and was hit," stated Taylor.
The 5-year-old still alive on scene was transported to Piedmont Columbus Regional, where he was later pronounced dead.
A death, Sheriff Taylor says, was senseless.
"He has no idea where he is or how to get home. Who thinks to tell a five year old to get out of a car because they're being potentially loud?" stated Taylor.

A Class B felony carries a maximum penalty of 60 years in prison. Secondly, that 60 years breaks down into 40 years initial confinement and 20 years extended supervision.

Since he is active duty I hope he gets a court martial and a dishonorable discharge, lose of all benefits, and 25+ years to run consecutive to what Texas imposes.
No telling how long the couple were together nor the relationship of the boyfriend with the boy. But what an awful thing to happen.
I for one do not believe “boyfriends” should be given the green light to discipline a mothers children......you want that privilege.. marry her.

Wasn't his child, and there WAS an instinctual intent to dispose of "some other dude's kid". Probably the biggest killer of male children is mommie's boyfriend.
