Summary below of the main takeaways, VOTE TOTALS, and suggested remedy from the MI lawsuit filed by Sidney Powell yesterday. This suit is MUCH more coherent than the rambling GA suit, thank goodness. Lots of overlap between the two as it relates to Dominion and the alleged Constitutional violations. As with the GA suit, converting the document to searchable PDF screwed up a bunch of formatting, particularly creating tonsofsentenceswithnospacesbetweenwords. Also worth reviewing with respect to MI election fraud is the Great Lakes Justice Center complaint against Wayne County filed 11/8/20: https://www.greatlakesjc.org/cases/costantino_v_detroit/ Against MI election code, election challengers were deprived of meaningful access to observe election process. There are 100 affidavits from credentialed Republican challengers who were denied access in Wayne County alone, specifically to TCF center where the counting and mail-in ballot processing happened. When given limited access, GOP challengers were routinely discriminated against, threatened, and systematically outnumbered:

• Not allowed to come and go from TCF center like Democrat challengers;
• Social distancing guidelines enforced for Republicans but not Democrats;
• Republicans called names and intimidated;
• Republicans told they would be removed by SWAT team if they asked questions;
• ”Tactics to Distract GOP Challengers" packet being distributed;
• Republican challenges to ballots ignored and not recorded
• Republicans prohibited from observing ballot duplication work when machine rejected flawed ballots;
• Ballot duplication only performed by Democrats not bi-partisan teams as per law;
• Democrats impersonated Republican challengers;
• Republicans not allowed to reference Qualified Voter File (QVF) or review changes made to it.

4:30am and 9pm ballot dumps on 11/4/20 at TCF amounting to tens of thousands of ballots; vehicles with out of state plates observed at the same time. Boxes brought in through the back of the room, highly unusual. All 4:30am ballots called for Biden according to what witness heard. All ballots in 9pm dump had zero records of voters in QVF or on supplemental sheets; records were added on the spot with 1/1/1900 birthday.

+100k ballots "discovered" two hours after two unmarked vans left TCF according to IT contractor on location.

Absentee ballots backdated to appear as though they were received before 8pm on 11/3/20. Republican challenger has a written note from an election worker saying she was instructed to backdate ballots. This is in addition to USPS whistleblower in MI (bulk backdating to 11/3/20 done by USPS in Traverse City if not other places).

Illegal votes cast and counted in multiple ways:

• People showed up to polls to vote in person without having to surrender their mail-in ballot.
• Batches of ballots run through counting machine multiple (5 or more) times. Dominion contractor as well as numerous Republican challengers saw this.
• Identifying numbers on ballots and envelopes did not match. When this was pointed out, challenger was ignored and told to go away.
• Ballots counted without signatures and/or postmarks.
• Large percentages of batches of ballots had the same exact signature on each envelope.
• Envelopes were "lost" at certain counting tables.
• Provisional ballots counted with no oversight.
• Ballots counted without secrecy sleeve or secrecy sleeve breached by official to view votes before sometimes placing ballot in "problem ballot" pile.
• No chain of custody on boxes of ballots dropped off after 8pm on 11/3/20.
• Dead voters.

Dominion (some claims unique to MI that are not made in GA case):

• Only one vote tabulating machine in Wayne County was tested before election;
• Trump team was only able to watch the testing of this one machine via Zoom. Faulty machines in Antrim County are what gave Biden 6k extra votes there. Wayne County is much larger so could significantly sway results if similar errors exist in some/many/all of their tabulating machines.
• Systems errors throughout MI routinely favor Democrats.
• Machines can be accessed remotely; no standards for physical security of machines.
• Atrium County was not isolated "glitch." Problematic machine should have been recertified once problem identified and resolved, but it was not.
• Non-whole number (decimal) vote totals make it highly likely that rank choice voting tabulation algorithm was active. Blank ballots were likely fed into the machines and fractionally counted for each candidate (favoring Biden).
• Pre/post 2am results drastically different and observed spikes impossible. Trump had 60% of all turnout points before they stopped counting at 2am in Wayne County. This was probably also accomplished by feeding blank ballots into the machines and programming the machines to count all/nearly all for Biden.
• Not physically possible to process the amount of ballots alleged to have been processed over 2.5 hour period with the machines available. Physical limit is ~95k; they reported ~385k.
• Images of scanned ballots kept inside system, but system can be set to put some images of ballots into "problem ballot" bin. Ballots in this bin can be wholly or selectively purged, with no trace. (Identical argument made in GA case.)
• Does not, by design, preserve or retain voting records, in violation of US election law. (Identical argument made in GA case.)
• Connections to Venezuelan election rigging for Chavez and other end-user weaknesses (p. 50 - 54 has a good summary, better than that in GA case.)
• Dominion VP connected to ANTIFA, on record wanting violence against Trump and saying this election is rigged. (Also in GA case.)

Vote totals -- note that certified results have Biden leading Trump by ~154k:

• 30k mail-in ballots "lost" (i.e. destroyed or replaced with blank ballots) (based on Matt Braynard's work)
• 30k mail-in votes cast for people who did not request mail-in ballots (based on Matt Braynard's work)
• 86k "excess voters" in two MI counties; all/nearly all newly registered voters since 2016 in select precincts/townships voted for Biden, statistically impossible and an anomaly based on results elsewhere in MI and nationally
• 13k illegal votes from people who don't live in MI (based on Matt Braynard's work)
• 290k more ballots processed in four MI counties than physically possible with available Dominion technology
• No other vote totals given for alleged Dominion vote flipping

The Charges (same as GA):

• Elections and Electors Clauses violated
• Equal Protection violated
• Due Process violated
• Widespread ballot fraud
• Five parts of state election law violated

The Remedy (mostly the same as GA):

• Decertify results
• Certify results for Trump
• Do not count mail-in/absentee ballots that violate MI election law
• Force production of ballots, envelopes, and other logs and records as required by law
• Do not count any mail-in ballots as the mail-in vote system is broken in MI
• Prevent MI electors from casting any votes
• Prevent counting any votes cast on uncertified machines
• Full manual recount or audit with signature verification
• Impoundment and audit of all machines
• 48 hours (11/3 - 11/4) of security camera footage from TCF

The remedy is where I get lost. Is she asking for some or all of those things?

It looks like this case ONLY challenges the outcome of POTUS. I am SUPER bummed that James isn’t involved and seemingly will not benefit. Maybe his race can be overturned in a separate lawsuit if Trump ends up winning Michigan or if the entire election there is thrown out? If this is taken up by any court, I don’t think they have the authority to change the outcome of other elections.

Why bother throwing out main-in ballots? Why bother with uncertified machines? Why bother with a recount or audit? The court said Trump won.

Prevent MI electors from casting any votes.

If the court then says that Michigan electors then can't cast their vote in the Electoral College then I guess nobody wins Michigan?

Around p.75 the GA suit devolved into a mess IMO. The entire structure from page one of the MI suit just seemed cleaner. That could be for the reasons you mention. MI definitely looks to be a series of really corrupt people at the local level doing really dumb, flagrantly illegal things (that they’re probably always done) whereas GA has higher-level orchestrated fraud via that ridiculous Settlement Agreement.

I’d think the smaller number of votes in GA would make things easier?? Trump has to come up with a bunch of different avenues to find 150k fraudulent votes in MI. Finding the 12k in GA seems a heck of a lot less onerous given the same sort of mischief was happening in both places, even if MI has 200k more people. Can you explain why fewer votes to overturn requires more specificity of argument?
