UP moves back a phase as Gov. Whitmer regresses a region for the first time (Michigan)

Gov. Gretchen Whitmer has moved the Upper Peninsula back to Phase 4 of her MI Safe Start economic reopening phases after a spike of coronavirus cases in the region.

The region will move from Phase 5, “containing,” to Phase 4, “improving,” starting Oct. 9. It’s the first region in the state to do so, although Whitmer has consistently warned that the reopening phases would go back and forth depending on the data.

**SNIP**

The change to Phase 4 will require people who can work remotely do to so, mean schools must follow stricter requirements for masking and place smaller limits on social gatherings.

“After seeing the increase in cases in the U.P. region over the past several weeks and consulting with medical experts, I have decided to take action to protect U.P. families and move the region back a phase. I know this is hard. I know it will be an adjustment. But we can’t let our guard down,” Whitmer said in a statement.

“COVID-19 is still a very real threat to our families, frontline workers, and small businesses. Everyone should implement these changes as swiftly as possible. This virus doesn’t care if you’re rich or poor, a Republican or a Democrat, young or old. No one is immune. Right now the most effective weapon we have is pretty simple: it’s wearing a mask that covers your nose and mouth. It’s washing your hands with soap and water. And maintaining six feet of physical distance from one another. Let’s all be smart and stay safe.”

Progressives - always going backwards. Whitler got the Supremes memo. Doesn't matter.

High court strikes down Whitmer's emergency powers; gov vows to use other means

Whitmer argued her powers will remain in place for at least 21 days, an apparent reference to a 21-day period in which the governor can request a rehearing from the Michigan Supreme Court.

I really don’t understand why something declared unconstitutional would not be ENDED IMMEDIATELY!

“Her Powers” - That’s what this has always been about.

If Trump wins MI it will be solely due to this woman.

No one is immune.

A virus is a virus and sooner or later you are going to come in contact with it, that's just the way is is. And when you do, you will either contract it or you won't and if you don't it's because you have some sort of immunity against it...........so her statement is wrong.

My nephew was sick with it for a couple of weeks but yet his live in fiance never caught it.............Immune?

Witless has said all along that she will not follow any court rulings. Remember the Barber that sued her?

Witless knows that she can do anything and nothing will happen to her. It is a shame that people will still obey her commands.

One of my friends got Covid. So did his wife and son. However, their daughter didn’t get it. She must have a strong immune system.

The only places paying any attention to that skank back home are the lemmings round Marquette MI and maybe Alger Co.

Her attorneys are not very good or she is not listening to them because no, if an act is unconstitutional, not only does she not have the power, but she never had the power. The vow to find other means violates a principal called collateral estoppel. She cannot relitigate the same set of facts, and all legal arguments as to why she had these powers needed to be raised before the courts or she waived the argument. Sure she can ask for a rehearing, but only to point out an error that the court made, not that her lawyers made, if any. And she can't act like she won or will win when she lost. Rehearing by the same court is rare and you have to provide clear arguments that the court made an error in its opinion that would affect the outcome.

Years ago my kids and my husband went down like dominoes with influenza. They were miserably sick and I didn’t want to catch it. An acquaintance told me to eat raw garlic as it’s anti viral. I did-a clove a day and I never caught it despite caring for five sick people in a small house.

When the shut down was looming this year I asked a doctor acquaintance about that. He said it was probably the vitamin C in the garlic. Vitamin C and D are so important in fighting all kinds of illnesses. Perhaps some people just have sufficient levels of C and D and are able to ward off this virus?

...no, if an act is unconstitutional, not only does she not have the power, but she never had the power.

But she has enforcers - presumably law enforcement - who are still making sure her edicts are carried out. Traditionally, public humiliation in the media would make a dictatorial politician back off after a court loss, but when the media agrees with a dictator's dictates, that does not happen.

Yard signs in my part of MI abound for Trump, followed by “My Governor is an Idiot” signs. Oh yeah, I’ve seen a few biden signs, but can count them on one hand.

Which subjects all of them to lawsuits for damages. They are on notice they they are acting without lawful authority and therefore their acts are their personal acts and not acts in any official capacity.

I would worry about liability for forcing the shutdown and bankruptcy of businesses under color of law.

Actually the state Supreme Court ruled she did not have the authority under two specific laws to extend the emergency after April 30 (court was asked by the 6th circuit to rule on the question).

So Gretchen says fine, I’ll impose the same regulations under different laws which I will find to fit. And I have 21 days to find new authorities because the Michigan Supreme Court ruling doesn’t take effect until then.

My daughter and I were in close proximity to my mother who got covid. We started swimming every single day, and drank a lot of orange juice. We didn’t get covid. Don’t know if that’s what did it, but it couldn’t have hurt. I’m a big believer in sunshine and Vit C.

The point is that her attorneys were bound to raise those issues. Not having done so they waived the issue. Assuming the SC denies rehearing it's stare decisis.

You didn’t understand my post. Read the ruling.

https://courts.michigan.gov/Courts/MichiganSupremeCourt/Clerks/Recent%20Opinions/20-21%20Term%20Opinions/In%20re%20Certified%20Questions-OP.pdf

She is going to keep her rules in place regardless, by relying on health regs rather than the two laws she erroneously, per the court, relied on before.

Quite likely. From a German study I read about, some people seem to have innate immunity. A very small percentage, probably due to genetic differences producing a higher red blood cell density, suffer very severe conseequences from excessive clotting.

From looking at CDC estimates a week ago, chances of survival for those < 60 are about 99.999%. For those above 60, 99.98%. It really isn't much different than a bad flu. The Spanish flu, by contrast, was almost 10 times deadlier than COVID-19, based on population.

My brother, his wife, her sister and both nephews got the WuFlu. The kids had sniffles. My brother and his wife said it was like a cold, and the wife's sister was like the flu. That's all that happened.
