Warrants aren’t needed when there is imminent threat to life (hostage situation, someone screaming help murder, etc.). That’s fine. Its the no knock arrest or search warrants I object to.

Anyone could bust into my house while I am asleep yelling Police! And what do I know. Instead of grabbing my 44 and shooting I cower. If they are bad guys then mission accomplished.

No knock warrants are wrong.

Then the police should have done a better job of getting evidence outside the home. If there were drugs in the home, it got there somehow. Sorry, not worth one DOG getting shot over.

That busting down the door of a private residence in a nation with 120,000,000 gun owners is very likely going to lead to needless maiming or death of either the homeowners or the cops?

Obviously the Founders never intended that search warrants should be avoided just because people might shoot you when you try to enter. The founders just wanted protections to keep cops and prosecutors from hunting for evidence when they have no basis to even be investigating you.

If there is reason to believe you're going to shoot the cops, assuming the Judge did his job and established probable cause that you are dangerous and that the items they need to acquire are in the home, then the police have every right to take precautions to protect themselves from that violence.

Is the system perfect? Do cops sometimes hit the wrong house? Do cops operate incompetently and people get hurt? Yeah, but also rarely. There are house raids going on all the time, every day, and cops retrieve drugs from houses filled with little kids and random drug addicts who pop in and out throughout the day. And yet, the cops manage to do it without hurting anyone, and rushing in and securing the location, protecting themselves and everyone else involved--99% of the time. The 1% I never see except in the news.

As another FReeper stated above, why not employ some patience and lie in wait for them when they go out for a Big Mac?

It's not just about retrieving the perp. Actually, usually it's just coincidental that a perp is arrested at all. They go in for the drugs, or the murder weapon, because they have specific information that the items are in the home. Then they arrest the perp when they get the evidence they wanted.

Can cops pick up the perp first and then hit the house? If there is probable cause to arrest the guy, sure. He'll get arrested anywhere cops can safely get him. But it doesn't always work out that cops have that sort of opportunity.

There may be some rare exceptions. e.g. a secret camera on the other side of the door shows that Hannibal Lecter is chowing down on a human leg on the other side of the wall and he has a special escape chute.

Otherwise, fugetaboutit.

I really don’t care if they announce themselves. If someone busts in and says that they are Santa Claus and it’s Christmas Eve, still won’t care.

I thought they announced their presence? No knock warrants may have been needed during the flash paper bookmaker times and may be needed today only to place suriptious listening devices but I never saw a reason for them in almost any other case. BTW there is a distinction between no knock and warrantless exigent circumstances entry like immediate safety or hot pursuit entry.

No, it’s not worth a drug bust. I’m not even sure there IS justification for no-knock.

I’m sure there’s enough creative folks in law enforcement to bring these situations to a close without killing half of the involved parties.

Correct. It was a SEARCH warrant for evidence. Not an arrest warrant.

All the news i heard about this and today was the very first time that the warrant was for HER violent boyfriend. The “news” made it sound like she was the victim of random police violence...or that the police had broken into the wrong apartment.
