Posted on 09/02/2020 1:41:34 AM PDT by Libloather
The push to recall Seattle Mayor Jenny Durkan is based on a policy disagreement, not a violation of any law or standard, and the petitioners leading the recall havent identified what steps Durkan should have taken in the wake of Junes widespread protests, Durkan argued in appealing her case to the state Supreme Court.
Durkans argument, filed Monday, reprises some of the arguments she made in King County Superior Court, where a judge ruled that the recall effort could move forward, but also adds some new ones.
Following the most widespread civil unrest Seattle has seen in decades, Petitioners submitted, and the trial court approved, a charge that Mayor Durkan failed to institute new policies and safety measures for the Seattle Police Department with regard to the use of chemical crowd control measures, Durkans attorneys, Rebecca Roe and William Shaw, write in the appeal. Remarkably, neither Petitioners nor the trial court identified the particular policies and safety measures Mayor Durkan had a duty to implement, but failed to enact.
There is no evidence that any discretionary decision Mayor Durkan made in the midst of multiple ongoing civil emergencies was manifestly unreasonable, Roe and Shaw write.
Allowing the recall to proceed, would chill the discretionary authority of public officials across the political spectrum, they wrote.

Tar, feather, rail, politician. You assemble.
Recall for incompetence!
The ex-police chief should run.
The push to recall Seattle Mayor Jenny Durkan is based on a policy disagreement,
Hey Jenny, policy disagreement is one of the very reasons for recall. If your polices are not supported by the voters, they have the right to recall you.
The time to make your case is in the election, not the court
I think I heard that yesterday was her last day on the job. She's available.
The left coast needs fumigating.
What’s the worry? Any petition effort to put the recall on the ballot will likely end up short by a few hundred “valid” signatures.
Silly Mayor. A recall is a political act, not a legal one. You have no standing to sue, as far as I’m concerned.
Socialists live by their own rules,,,,,they don’t like a voter to have retribution.......she has to go now,,,,kick her out...................
Seattle Mayor Jenny Durkan seems to be stuck on stoopid.
Kick her to Cuba. Or Communist China. They don’t have recalls there.
You can sue to stop a recall?!
In Washington state?!
Public office is an entitlement?!
Yeah you read that right. This recall effort is in response to her cracking down TOO hard. Durkan. Cracking down TOO hard.
You know it is bad when the liberals AND the conservatives want the mayors out! Same with the Mayor of Portland.
But - the trouble with this recall is that it is by the commies (not even the liberals). They would probably be able to elect that Marxist on the city council for Mayor.
“The ex-police chief should run.”
Good idea. She seemed like a decent, sensible, and law-abiding person. Considering all that’s happened, she might have a good chance of winning.
She was only following orders
