Judge: Gay couple’s child born in England is a US citizen

ATLANTA (AP) — A federal judge in Atlanta has ruled that the daughter of a married gay couple in Georgia who was born via surrogate in England has been an American citizen since birth, and ordered the State Department to issue a U.S. passport for her.

Made the correct ruling. Same as parents who adopt babies from Russia. They are American citizens.

The judge is saying that the child has the rights of a natural born child not of an adopted child.

If it's a real surrogate (yes) and one US citizen (yes) provides products of conception (yes) then why should it matter whether she was even born on Earth?

Under Jus Sanguinis, why would the child of any US Citizen not also a US Citizen?

I'm suspicious whether this policy would've been applied equally to a single heterosexual American whose daughter was born overseas to a foreign citizen. Based on people I've known, such a child would have dual citizenship.

My question is whether this policy is because of a flaw in the law (purview of Congress) or if it's just policy choice because of someone's politics. I'm also wondering if there's some important, distinguishing fact left out of the article. Based on the facts as presented, I'm with the judge here.

You'd probably say she's not even though her birth certificate lists two American citizens as her parents. She is genetically the child of one of them so under the principle of Jus Sanguinis she's definitely an American citizen but under Jus Soli, she could be (depending on the laws of the UK) a dual citizen.

I don't understand the origins of the State Dept's policy for this case.

Paternity is a legal fiction. If it were an American woman married to an American man who had an affair with an Italian man in England, the child would be American.

I feel the same. If they are both US citizens and this is a legal deal then best regards to them both. It isn’t as though this child is an anchor baby.

I don’t see how she isn’t born out of wedlock when the biological parents aren’t married to each other. I guess that’s too logical. And then there’s that pesky part, where the biological parent has to have lived in the U.S. for five years prior to the birth. Why do we have legislatures if the laws they make are just going to be ignored?

It might have been at one time, FRiend. But now we live in an upside down World. Everything that was once legal is now illegal. Everything that was once is now legal. It is confusing as hell to me. I just try to stay out of the way. And read all of Humble Gunner’s posts I can.

Not in my book, but meanie that I am, I would also exclude Chinese tourist babies and Anwar al-Awlaki’s kids unlike those who advocate for including “citizens of the world”.

I remember a while back, there was a case involving an adopted child who was born in a foreign Country, was adopted by an American couple (court issued the adoption papers) and grew up in America. The child (grown at the time of the case) was being deported because the adoptive parents hadn’t secured citizenship. I’ll see if I can find the case.

If this is the rule, get ready. Every child born from foreign women that were impregnated by American serviceman during conflicts overseas are officially citizens. And they aren’t anchor babies as they were not born on US soil. And the hundreds, if not thousands, of children born anywhere in the world to an American citizen mother or father since the passage of the 14th amendment in 1868 can now come home with a brand new passport marked citizen.

But if sperm or egg is considered the qualifying of a person’s citizenship, how can anyone with a DNA tract that matches an American citizen anywhere in the chain, not be an American citizen? That means everyone in the world is related to everyone in the US. So everyone is a citizen. After all, we all came from somewhere back in time. Slippery slope isn’t it?
