ATLANTA (AP) A federal judge in Atlanta has ruled that the daughter of a married gay couple in Georgia who was born via surrogate in England has been an American citizen since birth, and ordered the State Department to issue a U.S. passport for her.

I think a friend who adopted a Russian newborn did not have to go to court, aside from the adoption.
Using a surrogate is really nothing different than an adoption.
I know the “gay adoption” thing gets folks worked up. But as a matter of “law”, I don’t think this is way off course.

The surrogate business is illegal, but a separate issue from the child's citizenship.
If it were a straight couple and a baby genetically theirs delivered through a surrogate, the baby would be a US citizen and no need for a lawsuit.

Dont believe the judge would have such an authority to totally make up a ruling based on nothing like this. Then again this is America and we live in a post-law society

Not if it were adopted through a surrogate.
That is my point. I don’t think it is outrageous—other than the parents are gay.
Again, my point, is that as a matter of law—what they do with their sex parts is not relevant.
Of course...that, I will be declared the advocate for gayness of Free Republic for stating that. The lack of reading comprehension is stunning.
