"we expect the District Court to proceed with appropriate dispatch."

And some have pointed out that this has actually forced the DOJ to release documents and expose what was going on. Bigger stuff going on that we aren't aware of.

A Writ Of Mandamus would be a an order to do something. In this case, dismiss the case. They did not do that but sent it back to the Judge Sullivan (IMO) with a hint to finish this quickly.

The judge Sullivan, who doesn’t deserve the title judge, is trying to be prosecutor too! Complete abuse of power!

This is Judges protecting their own. Everything else be damned

I would expect Judge Sullivan to drop the case today since he was allowed to save face and his reputation. Time will tell

WASHINGTON (CN) — House Democrats cannot use the courts to enforce subpoenas, the D.C. Circuit ruled Monday, dealing a critical blow to an investigation of President Donald Trump from the chamber.

The 2-1 ruling marks the second time the court has invalidated a subpoena of former White House counsel Don McGahn by the House Judiciary Committee.

Democrats want McGahn to elaborate evidence that Trump worked to undermine the investigation of Russian meddling in the 2016 election.

While McGahn has refused to appear before the Democrat-controlled body, his testimony to special counsel Robert Mueller emerged as a critical feature of Mueller’s report.

The D.C. Circuit panel looked at the subpoena for the second time this year after the en banc ruled that the House had standing, if not necessarily a cause of action, with regard to the subpoena.

NOW: In a second bombshell ruling from the D.C. Circuit this morning a three-judge panel ruled the House can't go to court to enforce subpoenas, without a statute giving it the authority, in an opinion in the case to enforce a subpoena to former WH counsel Don McGahn.
