U.S. Court of Appeals for the District of Columbia Circuit responded on Friday to a petition for rehearing en banc by halting a prior order for U.S. District Judge Emmet Sullivan to dismiss the Michael Flynn case.

Upon consideration of the petition for the rehearing en banc, it is, on the court’s own motion,
ORDERED that, within 10 days of the date of this order, petitioner file a response to the petition for rehearing en banc. not to exceed 3,900 words. The government is invited to respond in its discretion within the same ten-day period. Any response from the government may not exceed 3,900 words. Absent an order of the court, a reply to the responses will not be accepted for filing. It is
FURTHER ORDERED that the effectiveness of this court’s order issued June 24, 2020, will be stayed pending disposition of the petition for rehearing en banc. See D.C. Cir. Rule 41(a)(3) (order granting writ becomes effective automatically 21 days after issuance in the absence of an order or other special direction of this court to the contrary).

Unless I am not reading correctly, I think all the D.C. circuit is doing is asking for Flynn’s lawyer and the DOJ to respond to the Sullivan request. It makes sense to me. My worry, unfortunately, is the full circuit will take up this case.

I doubt Sullivan has even looked at the recently released exculpatory evidence, even though he demanded it be turned over 2 years ago.
We are way overdue for an electoral revolution.
General Flynn is being held hostage by the radical left-wing judges.
It’s all a case of embarrassment for them. They don’t want to embarrass the democrats nor the Obama administration, nor the left-wing media, who all wanted Flynn convicted of a crime, any crime, so as to embarrass Trump and hopefully get Trump removed from office.
It turns out that, the democrats, judges and all, don’t want to admit defeat, or to undergo the embarrassment which they so richly deserve. Mostly, they don’t want Trump to have a big win headed into the election.
Trump needs to step up and undo this injustice, even if democrats proclaim that Trump is pardoning a criminal. It’s gone on long enough. And, by the time the election rolls around, most people won’t remember or care.
Someone needs to start playing hardball with these clowns...hopefully DJT!

Trump needs to take some shots at Roberts since it is becoming clearer and clearer that Judges are becoming more and more political. This despite the obvious bias and political decision of this judge who beclowns himself every day.

LAST NOVEMBER, President Trump, irate at a federal district court ruling contrary to his administration’s attempt to stop some migrants from seeking asylum at the border, blasted the judge, Jon S. Tigar, as a biased “Obama judge.” Standing up for the integrity of the federal judiciary, of which he is the titular head, Chief Justice John G. Roberts Jr. issued an extraordinary statement contradicting Mr. Trump, albeit without naming him. “We do not have Obama judges or Trump judges, Bush judges or Clinton judges,” Mr. Roberts said . “What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.”
We cannot vote our way out of this.
