Big Radio this morning was assuring us that Judgie still has a couple options to keep the case going against Flynn, and of course cut to commercial, and by then, I’d arrived to the office.
Da judge knows he was wrong but doesn’t want to admit it, so he can remain steadfast, reinforcing his strong convictions.
He also knows DjT will rectify the Flynn travesty, so he’ll let him fix it and take all the heat.
Any bets ?
Sullivan is probably on the phone with Obama and Jarrett right now. Give him time to get his orders!
Probably judge not finished with his opinion. If we’re lucky the judge will report government actions to disciplinary committees. He might also let the DoJ know how pissed he is about blatant Brady violations and the waste of time all the court sessions have been. He might issue sanctions to AUSA attornies.
Based on previous experience with Sullivan, those in the know expect Sullivan to require a hearing about a week from now before announcing his decision.
The NYT/Lawfare alliance found that the paperwork in the feds’s motion had Jessie Liu’s unique account number on it. (Honest mistake, or some paralegal swamp thing screwed it up on purpose?). This is possibly causing a delay until it is refiled with her successor’s number. Powell expected the ruling today or early this week, so it’s not time to panic. Sullivan might have had other cases on his schedule, or is researching feverishly to come up with an excuse not to dismiss.
Probably other things on the docket. Flynn may be “important to us”, but it’s just one more thing for the judges.

Judge is between a hard place and a rock. There has been obvious DOJ misconduct and his original order for the turning over of Brady evidence was shit upon by the DOJ, but he also needs to save face for allowing this clown show to go on for so long. If he doesn’t accept the dismissal request and sentenced Flynn, it will be immediately appealed and he will look like a fool. If he accepts the dismissal request and doesn’t violently savage the DOJ clowns, he will be mocked and publicly ridiculed.
I would not read too much into this folks.... courts have schedules and judges have calendars that are sacrosanct to them.
The court also has the right to ask additional questions to determine if the court needs to take action in response to such a bizarre turn of events.
Flynn is not in jail. He cannot be prosecuted now after this motion to dismiss as there is no longer any prosecutor.
The court likely has A LOT of questions (we all do) and the Judge is within the scope of his authority to ask them. The more questions that are asked and answered the more we find out so I hope he has a list of hundreds of questions for the government, for the prior counsel, and for the special counsel prosecutors. Even better, I hope he has a lot of questions for the FBI agents.
This probably won’t be anything great, but think of the possibilities?
He can put them ALL under oath in his courtroom and ask whatever he wants about the case.....
My prediction. Judge goes completely deep state. Says something to the effect of, “never has a person who pled guilty twice had a prosecution dropped.” He will ignore the prosecutorial misconduct completely. He will force Trump to pardon. My guess is this judge has been threatened.
The delay is due to the time that is needed to coordinate spin stories at CNN, NYT, and WA Post. The Judge when he releases the ruling will be assured that the “proper” media already has Democratic Party talking points in hand.
It’s maddening. Sullivan should have signed off and filed this last week

Judge Emmette Sullivan is a comrade of the Kenyan, he’s a lib democRAT. Over the weekend Obama ranted and raved about “justice” which he (Obama) has a one sided view. The guess here is that somehow Sullivan will balk as much as he can against the DOJ. Wouldn’t be surprised if he calls for a special prosecutor as the lame stream media will go along. He’ll go down swinging. After all, he already called Flynn a traitor.
This is the same judge that slammed the DOJ in the Ted Stevens case for withholding exculpatory evidence that. Although he ruled against Flynn early on some Brady disclosure, obviously he wasn’t provided the complete picture by DOJ prosecutors.

Does he have to issue an opinion on all the open items?
Can he accept the dismissal but require further hearings on the prosecution misconduct?
