What Good Are Constitutional Rights if They Are Violated When Americans Get Sick?
The Washington Times ^ | March 25, 2020 | Andrew Napolitano

“Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.”

— Benjamin Franklin (1706-1790)

One of my Fox colleagues recently sent me an email attachment of a painting of the framers signing the Constitution of the United States. Except in this version, George Washington — who presided at the Constitutional Convention — looks at James Madison — who was the scrivener at the Convention — and says, “None of this counts if people get sick, right?”

In these days of state governors issuing daily decrees purporting to criminalize the exercise of our personal freedoms, the words put into Washington’s mouth are only mildly amusing. Had Washington actually asked such a question, Madison, of all people, would likely have responded: “No. This document protects our natural rights at all times and under all circumstances.”

It is easy, 233 years later, to offer that hypothetical response, particularly since the Supreme Court has done so already when, as readers of this column will recall, Abraham Lincoln suspended the constitutionally guaranteed writ of habeas corpus — the right to be brought before a judge upon arrest — only to be rebuked by the Supreme Court.

Too many people (r44) don’t really have a clue as to how tenuous our freedoms are and how serious their abridgment is.

Well he is clearly ignoring the opening words of the Constitution. “When everything is cool and normal, this is the rulebook. But if any adversity hits, we revert to unaccountable authoritarianism.

Yes we do! And the sick or compromised or freaks of any sort can stay the hell home while the rest of us get back to work.

Certainly we can trust our elected rulers to honestly define “essential safety”, right ?
Look up ‘ Committee for Public Safety’.
Didn’t turn out well.

I love this President and understand what he’s doing. He sure as hell isn’t asking us to rat out our neighbors or “think of those who MAY become ill”

So buck up yourself and let the adults (who aren’t allergic to everything) handle it and live our lives.

I am so awakened, or woke, to see so called conservatives react this way, wanting spring breakers to be arrested for living life, people trying to enjoy this shut down by being outside and mingling with their damn families!

In NJ, it’s harsh and maybe your area isn’t and good for you. But in this state, it’s a clear violation of our Constitutional Rights and once the democrat/socialist/communists are in power we will be paying for it.

I support President Trump 100% and he’s not the one calling for these draconian measures in NJ and Philly. Are you stupid or naive? Do you live somewhere where this is not happening?

Yes, my Constitutional Rights are being violated so you can kiss my ass and shut up while some of us try to fight this.

I am shocked that so many on this site are just nanny state useful idiots.

What exactly are YOU doing? Are you a doctor or nurse or EMT? One of my daughters is a nurse in a well known philly hospital and again you can kiss my royal irish ass.

Some of you people are too stupid.

"Some business"

oh really....so this is just a little bump and who cares....

geez...

have you driven down the street lately?...almost all businesses and stores dark and shut down...

this is not a little bump in the road....this is a catastrophe...

I say that those who welcome this catastrophe are sitting safe in their castles and govt pensions and really could care less about the little people...

" Except in this version, George Washington looks at James Madison and says, “None of this counts if people get sick, right?”

Wonderful irony.

Napolitano is blissfully unaware that George Washington ordered the first mandatory mass vaccination:

"...on February 5th of 1777, Washington finally committed to the unpopular policy of mass inoculation by writing to inform Congress of his plan. Throughout February, Washington, with no precedent for the operation he was about to undertake, covertly communicated to his commanding officers orders to oversee mass inoculations of their troops in the model of Morristown and Philadelphia (Dr. Shippen's Hospital). At least eleven hospitals had been constructed by the year's end.

Variola raged throughout the war, devastating the Native American population and slaves who had chosen to fight for the British in exchange for freedom. Yet the isolated infections that sprung up among Continental regulars during the southern campaign failed to incapacitate a single regiment. With few surgeons, fewer medical supplies, and no experience, Washington conducted the first mass inoculation of an army at the height of a war that immeasurably transformed the international system. Defeating the British was impressive, but simultaneously taking on Variola was a risky stroke of genius.

Your ignorance of our government structure is breathtaking. Now I know to always ignore you in here in the future.

Ignorance like yours is what keeps spreading this crap. Find your boy pants and some patience. Because if you start going back to huge sporting venues, concerts, big restaurants, etc, then we will face quarantine that is actually enforced - only because little boys like you were told to wait while the adults were talking and you couldn’t stand it.

President Trump didn’t take away your rights. The governor that your state voted into office did. Too many Rats there? Move, butthead. My sympathy meter for you is zero, and I live in Washington where your former state citizens have turned this place into San Fran north.

But up here we seem to understand social distancing as a necessary evil to avoid actual enforced lockdowns. Because our curve is flattening here, this temporary loss of our freedoms is working, and I have too many friends with this virus for comfort. Maybe you should wake up and realize THIS IS NOT ALL ABOUT YOU. Damn I pity your wife.

Class warfare.

“a bunch of whiney losers complaining about their cancelled ski trips.”

Or how about a bunch of college educated, tax paying professionals complaining about decreased hours (doctors and nurses), nurses losing hours because the hospitals in their area are empty, or PTs put on hourly and don’t qualify for this “stimulus” and paying loans, or hairdressers, or wait staff, or so many more.

How about a bunch of people who did everything right and are still getting screwed and left out of this stimulus? My goodness some of you people are so clueless about our economy and the down line. But it’s all just about ski trips for you. Ugh, you’re too stupid to understand.

You’d rather create hysteria and post statistics and preach to your choir with likes and posts cheering you on. And some of us are making way more sacrifices than YOU. But you keep preaching to your choir here and like everything else you’ll be the most screwed and you can take you so called expertise and shove it because you have no expertise other than creating more people like you. Clueless to what’s really happening.

I’ll take my ski trip (non existent) and be on my way.

Seriously, you think the people on this site are more concerned about fantasy ski trips and that’s why we think you’re full of shit? Really?

And I have no sympathy for you.

Fortunately, I’m armed and I will die or worse, protecting that right, regardless of the “safety” from the government.

Your ignorance is breathtaking and I imagine common with our society today.

So hey, you do you and the rest of us will fight this.

I’m very well armed and trained from years in the infantry, and so are most of my neighbors out here in the sticks of Washington.

And who exactly are you going to fight there Twink? The National Guard, your police, who exactly? Just because they told you to stay away from others for a few weeks while this gets under control? Go for it.

Is your parent in a nursing home? Because most people put their parents in nursing homes and assisted living facilities and think that’s normal or ok. When it’s not!

So much comes out on these threads.

So called conservatives being ok with giving up their CONSTITUTIONAL RIGHTS for the good of society. Hah!

Citizens escaping NYC. Hell I would too! Yet lets tar and feather them for exercising their Constitutional Rights.Who here would want to be stuck there?

Your ignorance of our Bill of Rights is breathtaking.
