TOMBALL, Texas The disturbing story of an 8-year-old Tomball boy who was beaten unconscious at school Tuesday struck a chord with parents across the nation.
Christian Boynton, a third-grader, was ambushed when he arrived at Lakewood Elementary School, according to Kailee Boynton, his sister.
"They pinned my brother down. They were beating him. They beat him to the point of unconsciousness, where they continued to beat him," Kailee said. "They went through his backpack."
Christian was rushed to Texas Children's Hospital after being found unconscious in the bathroom.
Neurologists treated him for a brain bleed and monitored him for several hours before he was allowed to return home. He is expected to be okay.
Many on social media questioned whether the bullies who attacked Christian should be charged with assault. Others want their parents held accountable.
Tomball police say they assisted with the investigation, but determined the students involved are too young to be criminally culpable. Under Texas law, children under 10 cannot be prosecuted for committing crim

Yes. We had bullies back in the day. But until high school, they didn’t carry knives, guns, or engage in Clockwork Orange behavior that I know of.
Maybe authorities could charge the kids who DIDN’T cut off the lying sixth graders dreads. Because white boys EVIL, or something.
And I have been informed that in Texas unless you have planned out in advance to do harm you should not be charged and anyone who thinks otherwise is just a big meanie.
I had a boy bully me when I was in 3rd grade. He made me miserable. We finally became friends after high school and at our 50th reunion he told me that he had a major crush on me ,back then , and his hostility was his weird way of showing me how much he liked me.
This situation is just dangerous and the parents and school need to be held accountable.
Absolutely!
Thinking back, it was quite frightening. The kid who started the attack turned out to be a stone-cold sociopath as he got older.
I was interviewed by the police & told them what happen. What’s amazing is this incident happened as we were moving between classes. A lot of kids saw it.
We dont live in a system where police, prosecutors or judges should disregard the law and do the right thing.
Police, prosecutors and judges disregard the law ALL THE TIME.
Thats because a lot of todays 3rd grades are 15 years old.
And I have been informed that in Texas unless you have planned out in advance to do harm you should not be charged and anyone who thinks otherwise is just a big meanie.
I see that you did there.
Kid who was beaten is white. Want to put odds on thugs being “Hispanic”
In Houston I’d bet Mexican or some other Central American
“Thinking back, it was quite frightening.”
Bet it was! Sure hope the school at least expelled the brat! Probabally did not. Now you have to sue them before they do a darn thing.
If they want to stop acts like this name the kids and their parents.
I don’t remember if they suspended anyone, but if they did, they were right back in school soon. It was the early 70s.
The ringleader went on to do things as he got older that I could not even print out here.
Are the kids from a good family, or are they from a protected class?
Let me guess. They’re minorities, right?
The Dad needs to find the meanest lawyer in Texas.Go after the parents of these crotch goblins and the school board.
Any hospital bills?
Good reason to sue the parents and the school. If you suspect they are not U.S.citizens,call INS and turn their butts in. Provide a list of everyone in the school who isn’t. Provide their addresses. Do it until you feel your child is safe.
Been that way since the Sixties.
