Speaker Ryan: ‘You cannot end birthright citizenship with an executive order’

House Speaker Paul Ryan on Tuesday broke with President Donald Trump on whether an executive order could deny a constitutional guarantee of citizenship to babies born in the U.S. to noncitizen parents.

But despite Ryan's stern rebuttal to the president, the idea of limiting birthright citizenship still has significant cache among congressional Republicans, even if they aren't quite sure how to undo a constitutional guarantee stemming from the 14th Amendment.

Trump told Axios in an interview released Tuesday that the White House counsel had advised him that there was legal standing to terminate birthright citizenship, and Vice President Mike Pence confirmed that the administration was looking into using executive action as well.

I agree...but I also believe you can restrict it to those born to those under the Jurisdiction of the US of A. Which includes legal immigrants and excludes illegal immigrants.

Legitimate refugees and asylum seekers are temporary residents and are not applying for citizenship, so their children, born within country, are also not eligible for birthright citizenship

U.S. citizenship is only a birthright of those born in the United States and subject to its jurisdiction.

If an illegal alien commits a murder in the U.S., he can be prosecuted. If a foreign diplomat commits a murder in the U.S., he cannot be prosecuted because he has diplomatic immunity. Illegal aliens are therefore subject to our jurisdiction.

I’m surprised Ryan had time to comment on this. I’m sure he’s plenty busy these days checking out his cushy new office and staff on K Street and negotiating his benefits pkg. Too bad he’ll have to give up his congressional health plan. I’m sure something better is included in his new benefits.

By that logic, everyone is a citizen of every country.

All aliens are subject to the laws of the country in which they are physically present. However, they are also subject to the jurisdiction of the country of their citizenship. They not only must obey the laws of their location, but those of their country. That is inherent in every nation's sovereignty.

The 14th amendment's use of “jurisdiction” is well documented to be synonymous with “allegiance”. It was written that way, it was considered that way, and it was ratified that way.

Citizenship based solely on place of birth was part of monarchies. Basically; “You were born here. You belong to me.” We rejected that concept with the Revolution and the War of 1812. United States citizenship comes from the parents citizenship or naturalization, not place of birth.
