A Texas father-son duo are charged with murder after a dispute with a neighbor over a mattress turned deadly, shocking video shot by the deceased man’s wife appears to show. Warning – Graphic Footage: Viewer discretion strongly advised
In video of the Sept. 1 incident released Wednesday, Kara Box captured her husband Aaron Howard arguing over trash in their Abilene alleyway with next-door neighbors John Miller, 67, and his son Michael Miller, 31. “We had thrown out a twin mattress in a dumpster in our alley a few days before the shooting,” Box commented on the video, according to The Star-Telegram. “You have to have the mattress in the dumpster or they will not haul it away.”
Box says the Millers grabbed the mattress out of the dumpster and threw it on Howard’s property, sparking a shouting match between the neighbors. “Michael Miller who lives with his father ran went inside their home and got a shotgun,” The Telegram wrote in a Sept. 2 article following the incident. “Someone went into Howard’s home and retrieved a baseball bat.” The showdown ended with Howard shot after he stepped forward following a threat from Miller, who warned, “If you come within 3 feet of me, I’m going to kill you.” The Millers were arrested later that day. The Telegram reports they have since posted a $25,000 bail.

If his wife had been smart, she would have tried to get her husband to calm down instead of just videoing it.

He was probably trying to show her how brave he was, and had she not been there, he might have done the more sensible thing and left.
I guess I missed the part where they mentioned the mattress was infected with bed bugs. I think the objection was over space in the dumpster though.

Known bully and criminal shot by people who called the cops many times. Probably were told by cops to shoot him next time they were threatened. That’s my guesss. Disclaimer- I’m a known idiot that jumps to conclusions.
I think one problem they will have is that at least one of the fout shots were after he was down and on the ground.
All furniture and bedding you see out on the curb is bedbug. The situation is that bad.

The Texas "Castle Doctrine" will not apply.
"Self-defense" will not apply.
The shooters appeared to have provoked the incident, thus losing the presumption of innocence needed for a self-defense claim.
The decedent was an absolute fool to repeatedly threaten to kill two armed men, and lunge at them, as a response to the situation.
The Texas equivalent to a charge of voluntary manslaughter would seem to be appropriate. Might be garnished with an additional charge of assault with a deadly weapon (against the wife, when they ordered her at gunpoint to "get on the ground").
Could go either way before a jury.

My GF is currently on a five day road trip with her airman son returning to his base. I told her to pay the extra money and stay in the most expensive hotels they can find along the highway to avoid bed bugs.
Yesterday she called and said “you got us scared to death every time we get an itch”.
I don’t see it as entertainment in any way. I see it as informative since likely so many FReepers have firearms.
This will turn out to be interesting for several reasons, Texas is a state that gives a lot of leeway to protecting life and property so will be interesting what happens legally. Many legal issues can be brought into this, which may change the way shootings that may or not turn out to be ruled self defense.
In order to really try to understand the true situation it is good to have video to watch if possible. This video shows demeanor of the people and that can be important in a shooting defense.
No one has to go watch that video, that is a choice.
