Pot Or Guns: Oklahoma Medical Marijuana Users Prohibited From Gun Ownership

The legalization of medical marijuana comes with a big issue for Oklahoma's gun owners. If you want to get medical marijuana, you can't own or buy a gun.

Federal law prohibits any person who is an "unlawful user of or addicted to any controlled substance" from possessing firearms or ammunition. The law covers everything from owning, shipping, transporting or receiving any firearms or ammunition.

There are no exceptions in the law for medical marijuana users.

Some gun shop owners we talked to are a little concerned.

"That was my initial reaction - my gosh, we might lose some business," said Austin Warfield, owner of C.O.P.S. Gun Shop.

"We might lose some gun sales because if someone has a medical marijuana card, they won't be able to purchase a gun."

Warfield said they will be making sure any transaction in their store is legal.

"Well, they fill out the state or federal form 4473 background check," he said. "On that form is a question, are you addicted to marijuana or any other drugs."

Question 11.e. on that form asks:

Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.

The ATF recommends current gun owners make a plan about what they are going to do with their weapons before getting a medical marijuana license.

All this equivocating on bearing arms is an outrage.

Just substitute another enumerated right, say, the right to due process (5A).

It makes it easier to see how absurd restricting the 2A rights.

Both are legal but, one cancels the lawful possesion of the other.

Prozac is not a controlled substance (at least for now). Furthermore, if you are lawfully prescribed a controlled substance, this statement does not appear to be a problem.

Nonetheless, the controlled substance laws appear to be a problem. If you are diagnosed with addiction or opioid use disorder, that’s a problem. Any Suboxone user is tagged because it is FDA indicated for addiction, opioid use disorders.

You know that law enforcement is probably trolling through the controlled substance databases especially in states like CA. And will all the government access to medical records, any diagnosis could be a problem.

On the bright side, if enough leftists go for the pot card, we can disarm them.

Seems to me if the Feds can over ride a state right, then states should have to universally recognize Federal law.

It only applies in Colorado to those with a medical marijuana card, which can still be obtained.

Fair point, although the number of people in Colorado with medical marijuana permits has dropped substantially since it was legalized for recreational purposes in 2014.

So I choose to say that drug users should not be in possession of guns. Criminals should not have guns. Pot is illegal regardless of what a state might allow. Besides, the law is on the books, those people lying about pot use are committing perjury to then illegally buy a gun.
