Scanning our various sites ( even the Q-anon folks ) this subjecct is being talked about and it is RICO. Yeeoww, this is serious.
How can a corporation be guilty of a sexual act ? Surely there is something else they CAN be charged with.
a lot is explained in page 5.
hrc and Obama are mentioned on page 6.
Looks like a fraudulent filing which will lead to dismissal. Always seems to happen with the rich and powerful.
Well, if you go past the clickbait headline on FR from a blog pimp that doesn’t even bother to put up a brief summary, you’ll see it is a civil action, not a criminal prosecution. And since it’s being set up as class action, you have to wonder if the corporations are colluding with the plaintiff’s counsel to use this to insulate them from future lawsuits.
(As class action rules have been tightened, corporations have found them to be a useful tool. Plaintiff’s attorney will get a few million, class reps may get a few thousand, and everyone else may get a couple of discount tickets to Disneyland and some movie passes. And if victims don’t opt out, they can’t bring their own lawsuits later).
Weinstein was/is a perv, and Disney isn’t any friend to conservatives, but the RICO statutes have been stretched way of bounds from the original intent. It’s like the money laundering laws. Withdrawing money from an ATM for anything borderline illegal that would normally be a local misdemeanor can be stretched into a Federal felony charge just because you use cash (ask Dem perv Eliot Spencer). We should all be concerned about this.
All legal manipulations Conning the system instead of following the law.
Did you mean Eliot Spitzer? If not...who is Eliot Spencer?
WOW! 90 pages of detail about this POS predator’s tactics, accomplices and enterprise.
HOORAY women!

It's a small world, after all....

> youll see it is a civil action, not a criminal prosecution <
I took another look at the document....YOU’RE RIGHT
I put that in all-caps so that, hopefully, others will notice. A criminal RICO complaint - filed by the government - is serious business indeed.
But a civil RICO action is much less of a big deal. Anyone can do it. I just happened to stub my toe on a park bench yesterday. I could file a civil RICO action against the city and the makers of the bench, as they might have conspired to allow unsafe benches to be installed there.
Wasn't there something in Harvey's contract that specified that Disney would pay settlement costs for women who complained about him assaulting them?
In other words, the company knew and built the legal costs of his assaults into the budget.
Am I wrong on this?
Ask me if I would like Disney to get hit with as many bad things as possible.
First of all, I really believe that the whole Disney industrial complex should drop the name DISNEY. That man does not deserve to be associated with the current crowd of perverts.

Not really. As PAR35 first noticed (post #8), this is a civil suit. It just happened to be filed in United States District Court - Southern District of New York.
But Schtupid
Federal practice is notice pleading, and I’ve never understood the wisdom of writing a novel in the form of a Complaint. But, then again, maybe publicity is the strategy.
