Somehow that doesn’t seem like a very good balance of power to me. Mueller has conflicts of interest, as does Rosenstein.

Trump has to have approval for Cabinet Officials, but the DAG can appoint a Special Counsel, who has very little check on his power. And both the DAG and SC have conflicts of interest.

The system is designed for honest people. SC has a function, in principle, and the idea is to give them independence, sort of, and make it so they are not in fear of turf protection or being fired.

SC has TONS of check on his power, if AG (or DAG in this case) exercises it. See the regulations. Mueller should have been taken off the obstruction case long ago for conflict of interest; not just his, but Rosenstein is a co-conspirator in firing Comey!

It's pretty common for the system to look broken when the players are dishonest. See reams of SCOTUS decisions that are contrary to the constitution, and even to basic principle of separation of power.

Huber can't be a SC. SC must come from outside the government. Read the regulations.

But so what if he can't be SC. He can indict from where he sits, or supervise the prosecutors who are indicting. No need for a SC except to satisfy the lunkheads in Congress.
