The judicial system is predicated upon sloth. Lack of judicial research on founding principles and documents is a common denominator among all judicial branches. The absolute failure of the judicial system even among appellate judges to give even a modicum of attention to founding documents is appalling
Reliance upon precedent is the most common form of judicial indolence. All judges choose simply to rely on the opinions and findings of other judges as the sine qua non of judicial authority.
Thus does the fruit of the poisoned tree bear fruit to feed another generation.
Trump’s appointment of constitutional judges is a substantial departure from how the judicial system has been operating for generations.

I used to be on Twitter but got sick of the one-sided b.s. of the management, banning and shadow-banning conservatives while allowing every kind of garbage from the left. I know I should have stayed on to fight the good fight, but it was too nauseating to interact with so many scumbags.
However, there are a lot of good bits of info because of the public figures who do use Twitter for their own updates and observations. It’s just that there are so many a-holes to wade through....
There is no workable device for granting suspects knowledge they are being spied upon. The best we can offer is some assurance that the spying is just and reasonable based upon substantial suspicion of a crime or criminal behavior. Thus a judge is required to approve invasive efforts to gather evidence.
Gathering sufficient evidence of wrongdoing is required for indictment. The judge grants indictment based up the presentation of sufficient evidence to believe the charged person may be guilty of the evidenced crimes.
Once indicted the defendant is necessarily privy to all of the evidence gathered by the state.
A very stupid congressman from California was arguing with Tucker Carlson about this issue. He was thoroughly confused, claiming it was unreasonable for a defendant to learn of the evidence proffered to a court by a prosecutor.
Rebuttal is a fundamental principle of our legal system. For a leftist the charge alone is sufficient grounds for guilt if the accused is a patriot. If a SJW, not so much.

I’m not suggesting that the suspect should be granted knowledge that he’s being spied on. Simply wondering if the process of obtaining a warrant couldn’t be made stronger by including what I would call a devil’s advocate, someone that questions the evidence provided by the law enforcement agencies. This advocate would not be representing the suspect per se, but rather acting as a counterbalance to a possible rogue or corrupt prosecutor, as in this case.
For we all know that just getting indicted, even if you’re innocent can be devastating.
Kallstrom was with the FBI when he was leading the investigation into TWA 800 that was taken out by a missile in 1996 during Klintons relection in that year. But Kallstrom went with the scenario that it was a spark in the gas tank that killed all those folks. Cover up.

Elizabeth Warren,Pocohauntis, tried this by creating an independent citizens protection agency that would protect buyers from sellers, and ultimately the people from their government, I guess. After just a few years it is rife with corruption.
Judges are supposed to be the devil’s advocate, standing on the law as the arbiter of justice.
Sadly the rule of law is superseded by the rule by law. Trey Gowdy is one who rants continuously about the Rule Of Law as opposed to those who would rule by law, using the law as a weapon to further their personal interests.
It’s always better than anything else that’s on.
