How heroic locals exchanged gunfire with Texas shooter, ran him off the road as he tried to flee and shot him dead

Texas Department of Public Safety Regional Director Freeman Martin said that the neighbor, who has not yet been named, had 'grabbed his rifle and engaged the suspect.'.

Martin said that during the gunfight, Kelley dropped his Ruger assault rifle and got back in his SUV to flee the scene.

But another local resident, Johnnie Langendorff, who had witnessed the confrontation refused to let the shooter get away. Both he and the unnamed neighbor jumped in his truck and gave chase.

In a Facebook post, Langendorff's girlfriend Summer Caddel described how the pair had 'jumped in my boyfriend's truck and they chased that sick b*****d down in pursuit until the cops could catch up. He was able to run the shooter off of the road on 539!'

Langendorff told KSAT 12 that he'd been speeding at 95mph, while on the phone to dispatch, while the neighbor kept his rifle trained on the gunman's car.

As they approached a sharp curve in the road, near the 307 and 539, he said Kelley appeared to lose control and his car swerved off the road.

'That's when I put the truck in park,' he said. 'The other gentleman jumped out, and had his rifle on him. He didn't move after that.'

Caddel added that Kelley was gunned down within a few feet from her boyfriend.

Martin confirmed that police had found Kelley dead, saying that: 'We are not sure if it was self inflicted or if he was shot by a local resident.'

Cops also found multiple weapons and possible explosives in the vehicle.

“I read someone said he used a shotgun? (The hero- not the perp) not sure where they got the info from.”

Who knows - it could be either. I recall watching a recent TV show and the guy says “Take my rifle!” and hands the person a shotgun! I’m guessing TV writers and journalists have similar lack of knowledge when it comes to firearms.

Doesn’t matter much I guess - they both go bang and stopped and killed the killer.

Rule of law is rule of law.

Not sure why you think texas allows you to chase down a person and kill in cold blood..but uh..whatever

He was escaping and runs off the road.a citizen cant walk up and execute someone even if he just killed someone. Exactly what legal doctrine allows that? Judge jury and executioner???????????

Someone kills a loved one in your house and flees. You find him at McDonald’s. What texas law allows you to kill him?

Not saying he was killed in cold blood. I am saying circumstances make a difference. If he did not pull a gun on defender after car crash said defender could be in legal jeopardy as per law if he just shot him

I think the imminent danger and “in defense of others” would cover the person in that case since it was clear he had just killed many.

Although we’re still not clear on which bullet did him in.

Been arming for church for 7 years. If you’re going to get a concealed carry license you understand it is not for the purpose of leaving your weapon at home. Not under any circumstances.

I totally agree. Sad but true. I was hoping it wouldn’t come to this but you can’t leave your gun in your car anymore........sigh

Texas Law follows. It is similar to what my state has. Obviously it doesn't allow shooting someone that has surrendered, but it does allow shooting someone in the back as they are fleeing. (b) A person other than a peace officer (or one acting at his direction) is justified in using force against another when and to the degree the actor reasonably believes the force is immediately necessary to make or assist in making a lawful arrest, or to prevent or assist in preventing escape after lawful arrest if, before using force, the actor manifests his purpose to and the reason for the arrest or reasonably believes his purpose and the reason are already known by or cannot reasonably be made known to the person to be arrested. (c) A peace officer is justified in using deadly force against another when and to the degree the peace officer reasonably believes the deadly force is immediately necessary to make an arrest, or to prevent escape after arrest, if the use of force would have been justified under Subsection (a) and: (1) the actor reasonably believes the conduct for which arrest is authorized included the use or attempted use of deadly force;  or (2) the actor reasonably believes there is a substantial risk that the person to be arrested will cause death or serious bodily injury to the actor or another if the arrest is delayed. (d) A person other than a peace officer acting in a peace officer's presence and at his direction is justified in using deadly force against another when and to the degree the person reasonably believes the deadly force is immediately necessary to make a lawful arrest, or to prevent escape after a lawful arrest, if the use of force would have been justified under Subsection (b) and: (1) the actor reasonably believes the felony or offense against the public peace for which arrest is authorized included the use or attempted use of deadly force;  or (2) the actor reasonably believes there is a substantial risk that the person to be arrested will cause death or serious bodily injury to another if the arrest is delayed. (e) There is no duty to retreat before using deadly force justified by Subsection (c) or (d).
