All good advice. I’ve had my car totaled twice.

So, the first time, it was subtotaled?

I’m sure it is. We’re in the U.S., not China.

If I was in China, I’d be learning Chinese. When I was in Japan, I learned Japanese. When I was in Korea, I learned Korean. When I was in Italy, I learned Italian. The more I was immersed, the more I learned.

Never deal with someone else's insurance company. Always deal with your own. It is their job to deal with the other party's insurance company. Get your car repaired...possibly at a repair shop recommended by your insurance company...but you have the right to choose your own.

Your insurance company will pay the bill and it's up to THEM to get the other company to pay them back. It's a process called subrogation.

But according to what you posted, it may be too late for that. Still...try.

If you have “uninsured motorist” coverage (have your insurer tell you if you’re not sure), your insurance company should help you or pay for your damage because, in effect, the liability coverage of the at-fault driver is being non-responsive.

My two different cars. Actually, I ended up trading a ten-year-old for a two year old, and then for a brand new car. It was a good deal, except that I spent two summers driving rental cars and jumping through hoops to get it all done.

Never would have done it without all that great help from Amica.

If your car is not useable, they are responsible to provide a rental. The insurance company can refuse. If so, make note of it and rent your own. Get a nice one.

Tell them you have done so, and that at the end if they have not reimbursed you, you will file in small claims court for any unreimbursed damages...against their client.

I guarantee their client will not be happy, since they can't represent him in small claims court.

I deal with insurance companies more than I like. No one gives a d@mn what they say their policies are.

You should deal exclusively with your own insurance company. They will pay for the repairs, and then they will work out the financial details with the other company. You do NOT need to get involved. Who is your insurer?

Yes I did, it asked for $5000,and a month ago the insurance company called and said they will send me $2300...

That isn't right, unless the repairs are more than the car is worth. Your own insurance should pay for repairs and go after the other insurance for the cost.

What has your insurance said?

Also, don’t accept a check from them that won’t cover the costs. If you do they will consider the matter settled.

If you were parked and your car was hit you should not have to pay deductible. Did insurance company assess you were at fault or partially at fault because you were not parked safely for other cars to pass?

Did you sign any papers with insurance company?

Do you have a savy (smart) English speaking friend who can go with you to insurance company and deal with them?

What city are you in, maybe a FReeper will go with you?

If the other driver was at fault, your insurer should help you recover your $500 deductible.
If you can’t make yourself clear on the telephone, why aren’t you e-mailing your insurance agent instead of dealing with us yahoos? You made the problem understandable to us.

You’re caulking our butt cracks with cream cheese, aren’t you.

My apology for all the mean and embarrassing replies while you are asking for help.

I thought people on Free Republic had higher standards than most internet sites.

There are a hand full of butt heads here at FR and they make us all look bad. Probably angry drunks with no friends just a keyboard and a desire to make others as miserable as they are.

My insurance company said I can use my own insurance to repair my car, but I need to pay $500 by myself.
