I don’t think anyone in the IRS released the form.
If you look carefully, the second page has “client copy” stamped on it where Trump’s signature would have been. This indicates that they came from Trump’s accountant’s office, or from within the Trump organization itself.
Those who are suggesting that Trump trolled Maddow may well be correct.
And, if indeed Trump released the form to someone (e.g. the person Maddow got the form from), that doesn’t necessarily mean that consent was given to publish the form.
Unless more facts emerge that change my opinion, I still think that Maddow committed a felony.
If the person in the document gave it to someone else ten years ago, then the "consent" has already been given.
If the Trump administration warned her not to do it and then doesn't follow up with a criminal prosecution, then my theory is probably correct.

Prosecuting her is exactly what she wants.
Even if the 1st Amendment defense doesn't work, she won't get jail time.
(understand that the government cannot simply make a law that abrogates fundamental rights. If it could it could simply pass a law stating the police can search your home without a warrant whenever they have probable cause to believe a crime is being committed. There is a legitimate 1st amendment defense to this statute.)
But she can paint herself as a SJW fighting the Fascists in the White House.

It depends on the circumstances. If I have an accountant prepare and file my taxes, or if I use a product like Turbo Tax to prepare and file my taxes, I have given my consent to those people to have access to my tax forms. But that absolutely doesn't give them the legal right to publish those forms.
Disseminating a copy of a tax document to another party is not consent to publish, there is information contained in the document that is private, not public. Consent to publish would need to be expressly provided by the person or other legal entity whose private information was contained in the tax document.
This is NOT a matter of restricting free speech. It is a matter of law and privacy. If someone gave your local paper a copy of your tax return and they published it without your permission even though that is against the law, would you be ok with that?
She needs to be prosecuted and put in jail!
Understood. I’m thinking of a case where a public agency other than the IRS might have them. I understand state casino commissions routinely require financial disclosures from people who own casinos and/or are applying for casino licenses. I believe some of Trump’s tax information previously released by the New York Times came from his New Jersey casino license files.
Something else to keep in mind here is that we have no certainty that the 2005 tax return is accurate — even if it was prepared and filed exactly as shown. There is a chance — may even a very good chance, in the case of someone like Trump who files a very complicated return — that an amended 2005 return was later filed.

I understand that Trump beat Madcow to the punch by voluntarily releasing the tax return yesterday afternoon. If true, then Madcow did not commit a felony because Trump released the tax return into the public domain.
If I were Trump I would very definitely have her prosecuted.

I thought the same thing as you Mr. Douglas. Further digging turns up the WH released a statement regarding the returns and provided some details. But they did not release the documents
