He Said He Was An Undecided Iowan Until He He Received This Controversial Mailer From Ted Cruz.
Independent Journal ^

As Iowans prepare to head to the caucuses on Monday for the nation's first votes in the presidential primaries, the campaigns are pulling out all the stops. The mailer sent out by one Republican campaign, however, might end up backfiring.

Tom Hinkeldey, a resident of Alta, Iowa, tweeted a photo (which was later deleted because it included his personal address) on Friday evening of a mailer Sen. Ted Cruz’s campaign sent addressed to his wife, Steffany. The mailer was a large card printed to look like a manila envelope on one side and was labeled in all capital letters, "ELECTION ALERT," "VOTER VIOLATION," "PUBLIC RECORD," and "FURTHER ACTION NEEDED."

On the other side, the mailer said in red letters at the top, "VOTING VIOLATION."

Cruz spokesman Rick Tyler confirmed to IJ Review that the mailer was theirs in a phone call Friday evening, saying that the targeting had been "very narrow, but the caucuses are important and we want people who haven’t voted before to vote."

I agree with your thoughts on the subjects you touched on.

Nice point about Bachman. I hadn’t connected that campaign with this one, and you’ve tied it in nicely. There is some similarity.

I agree with you on that. I’m not a Ted supporter and I see it as unfortunate. Ted must be seeing something we aren’t to do this, because it looks like a very desperate move with nothing else to lose.

I agree with you.

Beck is fringe. He’s not the kind of guy you want tied to your campaign in a prominent way.

Maybe there’s something about Iowa I don’t understand when it comes to Beck. Does he have a big following there?

Are you freaking nuts? That mailer has been posted all over FR.

There are stories popping up all over about it.

Non-stop BS my ass. It's a big breaking story, a possible weekend game-changer in Iowa.

Now being reported by the (sadly) most influential paper in Iowa.

Ted Cruz, the "Constitutional Attorney", the "smartest lawyer in the room", by sending these "Voting Violation" mailers, in my opinion, violated the following federal election laws. Many States have similar laws.

The following is an image of a mailer Senator Ted Cruz sent out intimidating and threatening voters. It contains voter information and the information of the voter's neighbors.

It threatens "follow up notices" with no doubt information about if the voter voted in the caucus.

It attempts to intimidate voters by threatening public disclosure to neighbors of a person's voting record.

One must ask what does Senator Ted Cruz expect the person receiving this notice should do to their neighbors for not voting as Senator Ted Cruz demands, and what might happen to the voter if the neighbors are informed they have not voted as Senator Ted Cruz expects?

These are direct threats and intimidations in violation of federal election, civil rights, and postal laws.

The following PDF document outlines the federal election laws and the government's position on such matters for the purposes of prosecutions in such matters.

Federal Prosecution of Election Offenses Seventh Edition, May 2007

The following sections are from the above document.

42 U.S. Code § 1973gg-10 - Criminal penalties (violation of election law)
A person, including an election official, who in any election for Federal office-
(1) knowingly and willfully intimidates, threatens, or coerces, or attempts to intimidate, threaten, or coerce, any person for-
(A) registering to vote, or voting, or attempting to register or vote;
(B) urging or aiding any person to register to vote, to vote, or to attempt to register or vote; or
(C) exercising any right under this subchapter; or
(2) knowingly and willfully deprives, defrauds, or attempts to deprive or defraud the residents of a State of a fair and impartially conducted election process, by-
(A) the procurement or submission of voter registration applications that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held; or
(B) the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held,
shall be fined in accordance with title 18 (which fines shall be paid into the general fund of the Treasury, miscellaneous receipts (pursuant to section 3302 of title 31), notwithstanding any other law), or imprisoned not more than 5 years, or both.

18 U.S. Code § 594 - Intimidation of voters
Whoever intimidates, threatens, coerces, or attempts to intimidate, threaten, or coerce, any other person for the purpose of interfering with the right of such other person to vote or to vote as he may choose, or of causing such other person to vote for, or not to vote for, any candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, at any election held solely or in part for the purpose of electing such candidate, shall be fined under this title or imprisoned not more than one year, or both.

18 U.S. Code § 245 - Federally protected activities
(b) Whoever, whether or not acting under color of law, by force or threat of force willfully injures, intimidates or interferes with, or attempts to injure, intimidate or interfere with-
(1) any person because he is or has been, or in order to intimidate such person or any other person or any class of persons from-
(A)
voting or qualifying to vote, qualifying or campaigning as a candidate for elective office, or qualifying or acting as a poll watcher, or any legally authorized election official, in any primary, special, or general election;

(5)
any citizen because he is or has been, or in order to intimidate such citizen or any other citizen from lawfully aiding or encouraging other persons to participate, without discrimination on account of race, color, religion or national origin, in any of the benefits or activities described in subparagraphs (1)(A) through (1)(E) or subparagraphs (2)(A) through (2)(F), or participating lawfully in speech or peaceful assembly opposing any denial of the opportunity to so participate- shall be fined under this title, or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined under this title, or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death. As used in this section, the term “participating lawfully in speech or peaceful assembly” shall not mean the aiding, abetting, or inciting of other persons to riot or to commit any act of physical violence upon any individual or against any real or personal property in furtherance of a riot. Nothing in subparagraph (2)(F) or (4)(A) of this subsection shall apply to the proprietor of any establishment which provides lodging to transient guests, or to any employee acting on behalf of such proprietor, with respect to the enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of such establishment if such establishment is located within a building which contains not more than five rooms for rent or hire and which is actually occupied by the proprietor as his residence.

18 U.S. Code § 242 - Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death. And by the Iowa SOS..... I might add.

Surely you guys are goshin us. Then again, as the polls are not trending so well for PT Barnum, its time to beat a going nowhere drum.

I see too that your guy is talking about dropping out, seems the game is just costing too much for the thrill he’s getting.

***********************************

I used to watch Beck when he was over at FOX. IMO, he went off the rails later on at his channel. I now believe he’s just a performer that needs constant attention. And his meanness and mood swings have become too much for me.

I am a Trump supporter but I was so hoping for a Trump/Cruz ticket....until Cruz hooked himself to Beck. Or maybe Beck hooked himself to Cruz, I don’t know?

I don’t know about Beck’s following, apparently some people still listen to him.

I tapped into Beck a little before he left FoxNews. To me he seemed an acquired taste, and a bit wacky.

Some of his shows were informative, and I though they provided a service. Others were just pure hype and what I considered to be misguided.

I quit watching.

That reminds me of the scene from WAG THE DOG, where the Hollywood Producer and his ‘gimmicks’ specialists who are preparing to ‘sway’ the election (by concocting a false war and faking the footage) start asking each other who they would vote for.

They each and every one (for various reasons) admit they don’t vote ever, or quit because a long time ago the guy they wanted lost and they never got over it.

If Trump wins the nomination, will you be voting ?

Since when did breaking laws matter to politicians (or illegal aliens)? Laws are for 'little people'.

I have read that he will not apologize to anyone for the mailers. It seems that publishing the voting records of private citizens is OK with Sen.Cruz.

The longer this campaign goes on, the more I do not like Sen.Ted Cruz.

Yep. I’ll vote, but - for the first time in a loooong time, I’ll be voting my conscience and writing in Cruz instead of being forced to vote for a candidate that I am later ashamed for supporting.

There is nothing wrong with that and shows what strong support you have for your candidate.

I have solved the entire problem by having my own 'write-in' candidate.
