It was wrong not to read Miranda rights to Boston Bomber (Vanity)

Posted on 04/22/2013 4:21:10 PM PDT by honestabe010

#1 Eric Holder needs to be fired #2 Love these so called conservatives and proponents of "limited government" that support the violation of the 5th Amendment in the case of the Boston bomber because these are "special circumstances" don't you know?

Public Safety exception? They arrest him and then tell the public that there is no remaining threat. However, they want to tell us the public is in imminent danger? This is bullshit and opens the door to government stripping our 5th amendment rights whenever they please. Also, it may keep the man from getting the federal death penalty due to the fact you must prove intent, and much of what has been gathered from his statements without properly mirandizing him may be thrown out, I will say likely will be.

Am I weird and respect our country's founding principles and the due process of law too much?

he should have a lawyer,TIm McVeigh did and got put to death. What makes you think we cannot adjudicated cases like this properly within the Constitutional rights? We can debate whether or not the govt is taking the fact that Islam is is the root cause serious enough but we cannot pick and choose when to use the Constitution. It still matters. If people that have legal knowledge well beyond most of us are stating the possible implications, than i would assert they do matter. Furthermore, the fact that this administration or any other and its attorney general thinks they hold this type of power is scary. They effectively declared martial law in Boston and then went on to make a terrible case for removing miranda rights (they clearly thought it was important enough to do it.

Heck, as soon as they captured him, there was a lawyer already clamoring to represent him. I read that in the news ... LOL ...

They don’t need his testimony for a conviction.

You don’t get it....We don’t need his confession. And even now, he’s more than welcome to take the 5th on the stand.

All he had to do was write: "I want an attorney"...when the first question was read.

Does he know his brother is dead?

And you don't read rights to someone who is so weak and half dead. It's wortheless if he can't answer and is half out of it.

He knows his brother is dead. He ran over him. Plus during the manhunt for him he was tweeting “I will kill you all as you have killed my brother”

These legal rights do come through the government. There are other than legal rights.

We give rights to the government not the other way around. I know that goes contrary to what we hear all the time. There are no rights for government to give to us since they are already our natural rights.

He should know ... he’s the one that ran him down and ran over him!

When he committed his terrorist act, he lost his citizenship.
Gya! -- That, my dear fellow, is an extremely dangerous sentiment.

I once witnessed a citizenship hearing for a group of immigrants. The judge warned that their citizenship could be revoked. At least that is what I remember.

It's true there's a difference between Natural Born Citizenship and Statutory Citizenship -- conflating the two is possible (and easy to do, as Obama's situation has proven) and therein lies a bit of the problem: a revoking of citizenship, unilaterally, could be grounds for denying rights to some person. The 14th Amendment, it can be well argued, confers statutory citizenship on everyone born here -- so even a Natural Born Citizen could, in theory, be stripped of this citizenship. -- Now imagine "he lost his citizenship" as being in a prosecutor's argument (if you're lucky enough to get a trial, considering "indefinite detention").

No, I get it ... I’m afraid you don’t.

You see, there are precedents where CONVICTED murders are set free, AFTER the trial, because this step was missed.

Uh huh.

And I think they should peel the flesh off his skull with a ViseGrips and abandon him in Death Valley 75 miles from the nearest highway.
