#1 Eric Holder needs to be fired #2 Love these so called conservatives and proponents of "limited government" that support the violation of the 5th Amendment in the case of the Boston bomber because these are "special circumstances" don't you know?
Public Safety exception? They arrest him and then tell the public that there is no remaining threat. However, they want to tell us the public is in imminent danger? This is bullshit and opens the door to government stripping our 5th amendment rights whenever they please. Also, it may keep the man from getting the federal death penalty due to the fact you must prove intent, and much of what has been gathered from his statements without properly mirandizing him may be thrown out, I will say likely will be.
Am I weird and respect our country's founding principles and the due process of law too much?
How much you willing to wager? I accept PayPal........
this guy will get what he deserves, I am confident in that. But its a dangerous precedent to be set if the government can give flawed reasoning to take away miranda rights, whose to say that it will not be you or I? — anyways what spurred my comments where the comments of Judge Napolitano and Alan Dershowitz links are here http://www.realclearpolitics.com/video/2013/04/22/napolitano_dangerous_to_talk_of_suspending_suspects_constitutional_liberties.html — http://www.realclearpolitics.com/video/2013/04/22/dershowitz_authorities_will_regret_not_reading_boston_bomber_miranda_rights.html
His citizenship status is irrelevant. We don't have rights because we are Americans. Everyone has them because the rights are "endowed by their Creator".
How much you wanna bet he gets off on this technicality...
And his dead roadkill bro takes all the blame...
Which of the two killed the policeman?
So, this entire discussion is premature. If they give him his Miranda rights, fine. If they don't give him his Miranda rights, the only possible consequence is that the judge in his case might rule that the statements he makes in response to questions can't be used against him in his trial. Until that day comes, no one can be sure of what that judge will do at that time.
So, it's premature to worry about it today. We can't solve the problem today.
I’m all forgiven him a speedy trial followed by an even speedier execution.
I have come to the conclusion that most people on these boards think our rights come to us via the constitution and/or government.
When he committed his terrorist act, he lost his citizenship.
Concur with your analysis
I watched John Ashcroft on some late news show last night, and he said that there was no need to read him his Miranda rights. The authorities have more than enough evidence needed to convict this guy without any further statements from him. However, they do need his statements regarding if he is a part of a cell, or any other information he may have regarding who put him up to this or any group he belongs to or any other information like that. Miranda rights would just muck that up.
The intention in that part of the law is to determine if there is an eminent threat, such as in this case, more bombs.
Involuntarily Losing Your US Citizenship (Denaturalization)
Both the State Department and the USCIS have specfic laws and regulations they must follow in determining whether someones US citizenship should be taken away.
1. Convicted For An Act Of Treason Against The United States
Treason is a serious crime, and the Constitution defines the requirements for convicting someone of treason. Treason is waging a violent war against the United States in cooperation with a foreign country or any organized group. It includes assisting or aiding any foreign country or organization in taking over or destroying this country including abolishing the Constitution. Treason also consists of attempting by overt acts to overthrow the US government or of betraying our government into the hands of a foreign power. If you are caught and convicted of treason, you can pretty much count on losing your US citizenship as well as serving lots of jail time.
Lots of evidence out there that has nothing to do with any statement[s] he may make before he was read his miranda rights.
Do you know when there was last a conviction on a charge of treason? I don’t, but it has to have been quite a few years ago. I do know of a famous spy case in the 80’s, none of those slime were charge with treason, just espionage.

Gya! -- That, my dear fellow, is an extremely dangerous sentiment.
Consider that the DHS has already issued reports which basically paint political disagreement with the DC/elite as rightwing extremism (aka terrorism) -- to allow the government to unilaterally strip citizenship is a dangerous, dangerous step.
newsflash, during ww ii we did the same thing with the german sabatours that were caught.
we also treated us citizens that joined the other side as “the enemy”.
I just went thru my pocket constitution and I couldn't find "Miranda" anywere in it. Is it in fine print that I couldn't read?
Miranda WARNING. It is a warning that you have rights. The rights were recognized long before the decision that the police had to give you the Miranda warning.
