First, I will assume that everyone here knows that your smart phone has a camera, a microphone, and a GPS system built in.
Software running on the phone is capable of enabling/disabling those functions, gathering data from them and transmitting the data over wifi/cell connection to whomever wrote the software.
Clearly the technology is in place for a wonderfully efficient personal espionage system.
Further, we live in a culture in which normally honest people commonly break the law using technology because its easy to do (e.g. downloading music for free, thus stealing from artists).
So:
1. I wonder if the government is passing out free Obama phones in exchange for data acquisition (the Google business model), and
2. Does anyone know the circumstances that would make it legal these days for a government agent to tap into a citizens private smart phone?
Read the fine print on all google products.
You won’t be happy with what you read, once you wade through the legalese and let what they’re doing sink-in.

Legal? “They” couldn’t care less about legal shegal. I heard somewhere the other day that the fbi routinely gathers data and listens in. Be wary my friends. Be very wary. If you never want it repeated, never say it. If you never want it read, never write it down. It you never want it seen, never take the picture. You get the idea.

So , yes, and no. the folks that got those phones are not the ones they want to gather info about. We are at war, our own government is the enemy, and, sadly, they want to eliminate all who do not agree with them.
That is the way it goes when Marxism kick starts in every country it has ever been tried in.

Who says that the phones the Government hands out are private. They belong to the Government, I am sure they can do anything they want with the software before they hand it out. You take the phone, you take it as is, there is no contract stating which version of the operating system you are being provided with.
An employee where I worked was murdered. The cops tracked down a text sent moments before from inside his house. It made the case. They had the perps within hours of finding the body. I wondered how they did that.
You can write create an app and use it to spy on the government.
But I think you get arrested for spying.
Obama free phones are not smart phones, although some of the functionality referenced is present. I don’t think I’ve even seen even a Java app enabled phone under the Mobile Lifeline program. These models really aren’t even considered ‘feature’ phones. There isn’t a lot to work with as far as programming. You generally get a refurbished phone without choice of model. From what I just read, some of the providers do let you purchase a somewhat higher-end phone and use it according to the terms of Lifeline, but then it isn’t a free phone anymore (although the service is).
I’ve met one person that uses an Obama phone regularly and they say they can’t text, which doesn’t mean their phone calls can’t be listened to or they can’t be traced. Come to think of it I know one older lady that has an Obama phone because it was basically forced on her at a senior center. We pay for this phone but she never uses it— her family provides her with an iPhone, she’s quite tech savvy for 80 plus. She’s tried giving the Obama phone back and they won’t take it, also scaring her into thinking she needs a “back up” phone.
However, there are some groups in todays America that are quite properly traced. We all know who the groups are PC merely forbids us to mention them. There are other groups in our country that do not need to be traced as they have the necessary intelligence and self control.

Different here. A relative of mine has to re-justify it every year or it gets taken back (not the phone, actually, but the service ends). She also gets checked that she doesn't have landline Lifelink service as well.
Do they have a shocker on the phones to make the idiot who holding it submit?
The government decides what’s “legal.” If you have a phone they have the ability to track it and you will never know.
