N.J. men sue Subway, claim they've been shorted on footlong sandwiches

Two New Jersey men sued Subway this week, claiming the world's biggest fast-food chain has been shorting them by selling so-called footlong sandwiches that measure a bit less than 12 inches.

The suit, filed Tuesday in Superior Court in Mount Holly, may be the first legal filing aimed at the sandwich shops after an embarrassment went viral last week when someone posted a photo of a footlong and a ruler on the company's Facebook page to show that the sandwich was not as long as advertised.

At the time, the company issued a statement saying that the sandwich length can vary a bit when franchises do not bake to the exact corporate standards.

Stephen DeNittis, the lawyer for the plaintiffs in the New Jersey suit, said he's seeking class-action status and is also preparing to file a similar suit in Pennsylvania state court in Philadelphia.

45 years ago, I bought cedar boards for a fence. The newspaper ad said 28 cents per board ft. The boards were 1"x4"x6'.

I made out like a bandit and everyone in the store learned what a board foot was.

When the sandwich is wrapped and bagged, it must compress the bread just enough to make a sleazy attorney rich and cost everyone else more for a sandwich.

I'm more concerned about the Federal Reserve shorting me on the $5 than Subway shorting me on the footlong.

I have to say I agree it’s false advertising. I don’t think that should go unpunished.

It wasn’t a short day at the bakery or an employee mistake. It’s a company wide policy. They heavily advertise “foot long” and it just plain isn’t.

If I were in charge I would indeed make them 12 1/2” just in case. I think Subway has been purposefully dishonest and frankly pretty audacious.

When they shrunk the amount of tuna in the can, and the amount of ice cream in the container, they had to label it honestly. Why should we permit such large scale fraud?

Subway sandwich’s are not a foot long, more like 10 inches.

Sue them, they are lying like our government!

Foot long is subjective. They could hold up the founders 10 inch foot and say “this is what we mean by a foot long!” lame argument, but it might hold up in court.

However, a 6” sub that is not 6 inches. They can’t argue on that one.

The add was in error...It should have been lineal ft....or $1.68 per 6 ft. board.

I just happened to catch the error at the same time we were considering a privacy fence and took advantage of it. I was real proud of myself...and so was hubby.
