Two New Jersey men sued Subway this week, claiming the world's biggest fast-food chain has been shorting them by selling so-called footlong sandwiches that measure a bit less than 12 inches.
The suit, filed Tuesday in Superior Court in Mount Holly, may be the first legal filing aimed at the sandwich shops after an embarrassment went viral last week when someone posted a photo of a footlong and a ruler on the company's Facebook page to show that the sandwich was not as long as advertised.
At the time, the company issued a statement saying that the sandwich length can vary a bit when franchises do not bake to the exact corporate standards.
Stephen DeNittis, the lawyer for the plaintiffs in the New Jersey suit, said he's seeking class-action status and is also preparing to file a similar suit in Pennsylvania state court in Philadelphia.

I wonder how all the folks who ate their diminuitive footlong sandwiches are going to make their case. Have they not eaten the evidence? In fact...could the defense accuse the plaintiffs of destroying evidence?
They were counting on 12 inches, but only got 11. There’s a joke here somewhere.
If I were a judge I would toss the case for being a frivolous waste of time.
I was in a Pizza Hut when a custoemr came in with a tape measure complaining their pizza was not the diameter that was advertised.
As any woman can attest, it is not the size of the sandwich that is important.
End result will be $6 footlongs, pennies for those that actually prove they bought one, and millions of dollars for some lawyers that probably never set foot in a Subway.
God bless these bloody do-gooder lawyers ... our nation would never survive this kind of scam perpetrated by Subway. Our court systems were made for this very serious problem.

My wife had the same comment about me, nearly 30 years ago.
It’s cold up in Jersey this time of year. You have to expect some shrinkage.
Now the subs will be mashed into a mold in order to insure that everyone gets their designated inches.
I should sue the lumberyard, their 2 x 4’s are only 1 1/2” x 3 1/2”.
No doubt Governor Christie will call for tougher standards for footlong sandwiches.

Mine asked me to hurt her real bad so I ran over her with my truck.
Construction inspector for a while....diamter of an 8” pipe is less than 8”. People are just ignorant.
