I can’t speak for Naval regulations, but Army - definitely not. Retirees and honorably discharged Army may wear their dress uniform to funerals, at patriotic parades or parades on national holidays, and while travelling to their home of record within three months of discharge. Any other purpose is prohibited (with few exceptions such as teaching at a military facility).
It is a shame to see someone degrade the uniform. It is a poor choice and in bad taste.

Male service members shall not wear earrings while wearing their uniforms. Guess this thailor missed that block of instruction.

Personnel, including reserve forces, are prohibited from wearing military uniforms at political campaign or election events. Attendance at rallies, meetings and conventions as a spectator and not in uniform is allowed.
It applies to people who are still serving, active or reserves. My guess is the squid in the picture is no longer serving. Same with the OWSNYC Marine.
