As I understand it, yes, it needs to pass in both House and Senate.
It was introduced in the House of Representatives on March 26, 2009. And yes, I do believe there would be more resistance in the House. In fact, so many RINOs want this, I don’t even know if it’s worth fighting in the Senate much.
