Is Bobby Jindal Eligible To Become President If He Was Born Before Parents Were Naturalized?

I need some help on this. I was reading where Bobby Jindal was born to immigrants here on visas. If he was born in Baton Rouge before they became naturalized citizens, wouldn't that make him ineligible to become President? I am in a heated argument at another website over this and I need answers to this controversy. Any help would be appreciated.

jamese, when you can prove that the Constitution & original intent wasn’t written until the 21st century, 233 yrs after it was ratified, then & only then will you have a viable argument.

You are of the leftist persuasion in your application of principles, that is all is relative, Rules for thee but not for me. By saying that conservatives get these benefits you are implying that Obama is legitimate and whoever else they want to throw up because, ultimately, you cannot have rules that are only good for the opposition. The opposition is much better at this sort of game than any conservatives are, even you.

About as funny as a birther. :) Hey, I don’t like the president’s policies, so instead of fighting him on his policies, I’ll join this ridiculous campaign based on a conspiracy theory that he wasn’t really born in this country. Or, in the alternative, if he was really born here, he’s still not eligible because I found some old treatise that says you have to have two U.S. citizen parents to be natural born, 14th amendment be damned. It doesn’t matter if I’m quoting non-Americans and basically pimping for foreign law to be the basis of our jurisprudence. It also doesn’t matter if the guy I’m quoting died before the Revolutionary War even STARTED and before the U.S. was a blip on the world’s radar. Awesome!

What does it say about the state of the birther movement when you appear to have at least slightly more intelligence than the leader of it, emigre dentist and correspondence attorney O-rly? That can’t be good. I think you should challenge O-rly for leadership of it.

If you believe it to clear that Obama is not a natural born citizen, regardless of his birthplace, why did you not make a bigger argument about it when he was running for President?

I’m not an attorney, I don’t need to prove anything. I simply comment on a political internet bulliten board and state my opinions and what I observe in the real world.

I’m sure that you are aware that James Madison proposed what became the 27th Amendment to the Constitution in 1789 and it only took 202 years for that Amendment to get ratified in 1992.

“Original intent” was for Senators to NOT be directly elected by the people, for women not to be able to vote, for slaves to count as 3/5ths of a free person for purposes of congressional apportionment and for “Indians not taxed” not to count at all for purposes of congressional apportionment.
The framers established a system of amending their work.

Another after-birther defense when all fails is to fall back and claim that we can not fight more than one unconstitutional policy at the same time. And FYI...the citizenship conspiracy was promoted in your own state by Jefferson in 1779:

Be it enacted by the General Assembly, that all white persons born within the territory of this commonwealth and all who have resided therein two years next before the passing of this act, and all who shall hereafter migrate into the same; and shall before any court of record give satisfactory proof by their own oath or affirmation, that they intend to reside therein, and moreover shall give assurance of fidelity to the commonwealth; and all infants wheresoever born, whose father, if living, or otherwise, whose mother was, a citizen at the time of their birth, or who migrate hither, their father, if living, or otherwise their mother becoming a citizen, or who migrate hither without father or mother, shall be deemed citizens of this commonwealth, until they relinquish that character in manner as herein after expressed: And all others not being citizens of any the United States of America, shall be deemed aliens.

Take it up with your ancestors if you don't like it. You might also read the appendixes of Tucker's Blackstone in which Tucker dispells the myths that English common law had any force in any of the United States or Federal Govt after the revolution & ratification of the consitution. In fact, Tucker tells us that the common laws brought over by the Dutch & the Swedes that were based on natural law, "jus sanguinis" was not thwarted by the British invasion of 1763.

Did you forget the little known fact that not all colonies were established by the British & their laws were not those of the Brits prior to 1763? Good thing the good professor from William & Mary didn't.

Not eligible, end of story. Jindal will never be President for more than one reason. He isn’t eligible and he will never be elected. That’s just the facts. Can we just have a normal President that we don’t have to worry about? How about a real American next time? We already have had one usurper with dual allegiances to god knows how many other countries and once is enough.

Hey, I don't much like it either, but that's the ugly truth of it - or at least the truth as practiced by the US Government today in Title 8 of the U.S. Code. If you can come back and tell us where in the 14th Amendment + Title 8 it says this ISN'T possible, please do, because it would probably make a lot of people happy.
