I cant believe she is asking for so little.

She’ll win.

99% of the time the owner of a dog is responsible for injuries caused by it. Even thought the laws don’t generally say it, dog bites are essentially covered by strict liability concepts.

Dog owners should do a minimum prison term any time a dog (unprovoked) injures a human.

I doubt that the dog returned inside and attacked her. More likely, when the dog came in/was brought in, she rushed to “help”, and apparently she did not know that it is a BAD idea to approach an injured, strange dog—it is more likely to bite you than its owner when in pain and frightened.

I suspect that the owners will be charged with failure to secure their labrador properly; I don’t know if the woman will be awarded any money for the bite. Her suit may be dismissed.

Unless she is also suing the driver of the car that hit the dog, the case should be thrown out of court.

interesting. i’m seeing a lot of comments of “its a lab, it MUST be the victim’s fault.”

we all know full well if it had been a pit, these same posters would be calling for not only having the dog put down, but the owners as well.

The dog owner is toast. He is responsible for off leash injury to the dog, and dog bites of guests both as the dog owner and property owner.

The fact that she’s asking for such a small amount of money—just lost wages and medical expenses—indicates that she’s not doing this out of some malicious desire to make money off of the owners. She probably has no choice but to sue the dog’s owners, who may even understand and accept that this isn’t a case of the bite victim vs. them but her insurance company vs. their insurance company. In other words, the insurer is at the back of this, trying to recover their outlay on her claim. And this is what homeowners have homeowners’ insurance for.

If, as a right-handed person, I had sustained permanent damage to my right hand, I’d be asking for a lot more than $50K.

The Pit Bull of a friend's granddaughter was roaming free in a rural open range area and was struck by a vehicle. Two women in a different vehicle stopped to render aid to the seriously injured dog (had to be put down due to it's injuries). The injured dog seriously injured a hand on one of the women, and bit the other woman. They sued my friend for the injuries and pain and suffering. The dog wasn't his, but was residing on his property (though the accident occurred several hundred yards from his property). His insurance provided a settlement payment. Seems to me that if a person stops to render aid to an injured animal, regardless of what kind of animal, that person has intentionally placed themselves at risk. Just my 2 cents.

In this case, the situation is different in that the dog attacked a visitor in the home. However, injured animals do act/react differently than an animal that isn't injured. I doubt this Lab was "vicious", but was reacting to pain.
