82-Year-Old Homeowner Who Shot At Men Stealing Trailer Sentenced

An 82-year-old Wheat Ridge homeowner who was charged after police said he shot at two men stealing a trailer from his property, was sentenced Friday.

Robert Wallace was given two years of unsupervised probation and he can't own a gun.

Wallace agreed to a plea agreement in which charges were reduced to criminal attempted manslaughter and illegal discharge of a firearm, instead of the initial four charges of attempted first-degree murder.

"No one won," said Wallace as he left the courtroom.

Wallace agreed to let the state destroy the gun that was used in the shooting. Other guns he owns will be sold with the money possibly going to pay his legal fees.

Jefferson County District Attorney Scott Storey said, "It is illegal to shoot someone who is stealing your property."

Storey had taken heat from the community following the initial charges of attempted first-degree murder as information concerning the two suspects immigration status surfaced.

"Immigration status did not play a role in this decision," said Storey.

Storey said Wallace "was not overcharged" with the initial charges of attempted first-degree murder. He said charges are based on the law.

Storey said a disposition was reached before public outrage on this case.

One of the suspects, 28-year-old Alvaro Cardona-De Lorea, was shot through the eye, leaving him with brain damage and a disfigured skull. Cardona has undergone a competency evaluation which showed he may not be competent to stand trial. His case has been continued.

The second theft suspect, Damacio Torres-Ochoa, 32, was arrested by federal immigrant authorities at his Boulder workplace on an immigration violation, authorities said. Torres is charged with theft of an at-risk adult. His next court appearance is Oct. 4.

Absolutely. Criminals are the real materialists. Use of property is a much higher calling than theft of property.

If I lived in this area, I'd make it a part time career to make sure District Attorney Scott Storey never works again in the legal field.

TAMPA - A Tampa woman died late Sunday after she was attacked by her boyfriend with a machete while her daughters looked on, police say.

Officers were called to 2202 East Thrace Street around 8:30 p.m. They found the victim, 50-year-old Danzita Fonseca, inside the home. She was taken to Tampa General Hospital were she died.

The victim’s two daughters and one of their boyfriends witnessed the attack, police said. At one point the suspect, 39-year-old Alexander Cote-Ferrer threatened the witnesses, with the machete. They fled and called 911.

Cote-Ferrer was arrested and charged with Second-Degree Murder and three counts of Aggravated Assault.

He was arrested and released earlier this year on charges of Aggravated Assault with a Deadly Weapon.

Right, so long as the shooter realizes he gets the death penalty if he misjudged an innocent.

I mean thieves the household or business owner or robbed person witnessed thieving. Not just random people running around.

I’m serious.

The death penalty is way underused. Prison sentences are way, way over used.

Public canings and executions are the way to go. And making lethal force to defend oneself, one’s dependents and property legal.

I was essentially agreeing with you. There would need to be some serious accountability to discourage frivolous shootings [of course]. The problem is our culture of accountability is stinked up by the left.

The problem is our culture of accountability is stinked up by the left.That's it in a nutshell. And it's going to have to be rivivified, one way or another.
