He was arrested for protecting his property and family.
But its how the Long Island man did it that police say crossed the line.
He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2s Pablo Guzman.
George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious MS-13. He said the whole deal happened as he was about to drive his cousin home.
I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, Can you please leave? Grier said.
Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.
He starts threatening my family, my life. Oh youre dead. Im gonna kill your family and your babies. Youre dead. So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass, Grier said.

To give an indication of the mentality of the deceased punk in question: the punk's father stood in gallery and gave a "whoop whoop whoop" when that homeowner was sentenced. When a TV reporter asked the father after the sentencing how he felt, he smiled and told the reporter: "I'm going to Disneyland!" In other words, he knew his multimillion dollar wrongful death civil suit was right on track.

i solved such a problem in the past without firearms. the solution is simple, but unfortunatley it can not be shared in such forum.

I wouldn’t advertise that I have a gun. If they try to come into the house, shoot them as they cross the threshold. IMHO, firing warning shots just shows them you are afraid to shoot them.

It doesn’t take a genius to figure this one out. The man did everything right (told someone to call the police, etc) except go back outside with the gun. There’s a million things that could’ve gone wrong when he fired the “warning shots”.....innocent bystanders, babies in cribs in other houses, all kinds of what-ifs. That would be where the “reckless endangerment” would come from. Had he stayed in the house, positioned himself at the base of a funnel point and just waited then he could’ve been 100% in the right when he picked off the gang members one by one as they came through his front door. The reality of it is he had good judgement but made a bad decision.
If I was his neighbor I would then learn from his mistake, have everyone in my family trained with their own firearm and then coerce the same thugs to my property....and finish it properly.

He had seconds to react with 20 gang members threatening to kill him and his family.
Maybe a couple of cousins with baseball bats would have helped too...
