NY school sued after teen suspended over rosary

ALBANY, N.Y. (AP) -- A federal judge on Tuesday ordered a school to reinstate a 13-year-old boy who was suspended for wearing rosary beads, pending a hearing into whether the suspension violated his civil rights.
Oneida Middle School officials contend Raymond Hosier violated a policy banning gang-related clothing, as rosary beads are sometimes worn as gang symbols. But the seventh-grader, who initially was suspended two weeks ago, says he wears the purple rosary in memory of his younger brother, who died while clutching it after a bicycle accident.

Of course they violated his rights, it is called the first amendment. The government, no matter what form it takes, has no jurisdiction or authority to forbid people to display or wear artifacts of their religion.

UPDATE:
Raymond Hosier, the Oneida Middle School student suspended for wearing rosary beads, will be able to wear the beads to school.
The American Center for Law and Justice, (ACLJ), filed a lawsuit against the school district Tuesday in a federal court, saying the school violated Hosier’s free speech rights.
Now FOX23 News has learned Judge Lawrence Kahn has issued a temporary restraining order which orders the school district to allow Hosier to attend school, wearing the rosary beads.

Some wear it as jewelry, some don’t. But it isn’t up to the school authorities to decide who does and who doesn’t.
If he has gang affiliation or gang history, ban him from school for that. Not for wearing beads.

This good catholic boy needs to be clearly apologized to. That said,,,it’s always seemed odd to me that the hispanic gang culture openly sports the symbols of the church on their tattoos, etc.
It would be odd to be murdered by a killer with a tattoo of the virgin mary, a bleeding heart, etc.
