A woman has come forward claiming Roman Polanski abused her over 25 years ago -- when she was 16 years old ... 4 years after Polanski fled the U.S.
Charlotte Lewis -- who co-starred with Eddie Murphy in "The Golden Child" -- was front and center at a Gloria Allred news conference that ended a few minutes ago ... claiming she has now told authorities her story.

Why would the age of consent matter if the charge being made is rape?

Because in pleadings to the court, Polanski's defense team have asserted that whatever happened to that 13-year old girl was an isolated incident and that Polanski was never a threat to society. Since this accusation is alleged to have occurred some 4 years after the incident for which he pled guilty, her testimony seriously undercuts the defense claims.
She was aware of the argument Polanski was making, and she felt obligated to set the record straight.
It wouldn't, but it would be an aggravating circumstance, and an additional charge. I think TMZ just pointed it out to avoid any kind of libel liability themselves.
I have never understood the attraction for women that are younger.

Actually, as a young teenager, I always had more hots for the twenty something teacher than girls in my grade who acted so.... young.

I haven't read those statutes in some time, BUT most of the states (perhaps all) that have an age of consent of 16, also employ a two-year rule - IOW, their sexual partner must be within two years of age of them, or consent cannot be given.
Polanski, already in his 40s in the mid-80s, clearly wasn't within two years of 16.

Well, good for her and God bless her. She’s going to get chewed up and spit out. I’m not a big Alred fan but, she will do the job.
