Police search house of Gizmodo blogger, take Mac, cell phone in iPhone leak investigation

FREMONT, Calif. (AP) -- A blogger who posted pictures and details of a lost iPhone prototype has given up his computer, digital camera and cell phone to law enforcement.

A special computer-crime task force made up of different law enforcement agencies searched Gizmodo blogger Jason Chen's house and car, according to a statement and search warrant documents provided by Gizmodo.

The warrant says the computer and other devices may have been used to commit a felony.

Apple did not immediately return a call seeking comment.

Police Seize Jason Chen's Computers Last Friday night

California's Rapid Enforcement Allied Computer Team entered editor Jason Chen's home without him present, seizing four computers and two servers.

They did so using a warrant by Judge of Superior Court of San Mateo. According to Gaby Darbyshire, COO of Gawker Media LLC, the search warrant to remove these computers was invalid under section 1524(g) of the California Penal Code.

Here is all the documentation (Jason Chen's personal details are pixelated).

You were saying ...

Wow, and the guy even returned it.

Well, he didn't "get nailed" for that crime. If he had not returned it, it would probably be another "bullet point" on the list of charges he'll probably have...

Apple is being petty about this. The guy could have sold it to anyone that might be a competitor, hacker, er, never mind.

Apple has not brought these charges. Apple was just requesting their prototype back. The DA and the police are acting on their own, as the are required to.

If proving your point is that the police get warrants for probable cause to investigate a crime (with particular equipment that may be involved) and that judges signed warrants for the police to investigate crimes that they have probable cause for -- I'm glad I'm proving your point -- because that's my point too ... LOL ...

because there’s apparently a law in California that makes it illegal for what he did

Of course, everything one does is illegal. Persons cannot live one day without breaking several laws.

Why should he be nailed for anything.

He FOUND it.

There was no legal, perhaps an ethical, obligation to return it.

What crime was committed?

I believe Kalifornia also has a law still on the books that makes it a crime not to boil your dust rag after using it. The way people are saying Giz committed a crime have yet to say if the act is a real crime or just another stupid law passed by stupid politicians.

Apple is big on drama.
So are their fans.

I’ll pass.

Why do i read these threads then?
The entertainment.
Keeps me from watching soap operas.

Steve “Hitler” Jobs used his considerable political clout and influence to get the cops to be his stooges. Jobs is a thug. Closed, secretive, and throws temper tantrums when things dont go his way. Apple is everything they accuse Microsoft of being. Apple treats its most loyal fans and customers with contempt.

WE HAVE A WINNER! This is exactly what happened. Was it maybe illegal? Possibly.Do the cops have anything better to do? Problably. I just hope this helps Gizmodo stop drinking the Apple Koolaid and more fairly report on the overpriced crap made by Apple.

Let’s hope CNET follows Gizmodo’s path.
I used to like that site. It used to have some informative articles.
Now it APPLE 24/7, ‘I’ this and ‘I’ that.
yuck.

I have always disliked that obnoxious arrogant clown and all of his loyal followers.

Why should he be nailed for anything.

No, actually he didn't find it... he bought it from someone who found it ... you see... :-)

There was no legal, perhaps an ethical, obligation to return it.

Ummmm.., no..., there was a legal requirement for him to return it, when asked to return it. And he did. That wasn't the problem, though.

What crime was committed?

It wasn't legal for him to buy that property... :-)

I am not seeing the crime here. I daresay this little slip was insulting to Apple, and rather than take their lumps at the human error, they chose to see what they could do for revenge. Rather thuggish. Do not tell me there was no pressure on the cops / DA from someone at Apple. Riiight.

This Gizmondo editor has a right to hold his sources private.

The idea that the phone was “stolen” is ludicrous.
