Phil Hare in Full Damage Control Mode after Saying He "Doesn't Worry About the Constitution"

Here is video of Illinois Democrat Rep. Phil Hare saying the U.S. Constitution "is near and dear to me," just one day after having been caught on video saying he "doesn't worry about the Constitution," when asked where in the Constitution the Congress had the authority to pass ObamaCare.

Hare complained about the "gotcha journalism" of today, and said he had been "taken out of context."

Watch the video below (Via SharpElbows.net) of what Hare said, and it does not sound like he was taken out of context. It sounds like he is clearly saying he just wanted to pass ObamaCare to provide Government help to 32 million people and he really didn't care whether there was Constitutional authority to do it or not! He's now in full damage-control mode.

Is this the actual video and he’s giving the finger? I know he’s stupid for saying what he said and knew a camera was rolling. But is he stupid enough to give the finger when it’s his own camera? Does he think viewers won’t see this?

Talk about diggind a hole!

We need to start calling out every leftist who flips the bird and we're not supposed to notice.

Like when Obama was flipping the bird in the Republican health care summit, one of our guys should have said, "Mr. President, with all due respect, I've noticed you extending your middle finger at us, like what you are doing right now. It's offensive; do you mind according us the respect we accord you?"

Let’s be clear and state it up front:

Actually, the Constitution IS more important than people’s lives who might be denied health care.

Sorry, it just IS.

If there is a conflict between the two, then formally AMEND the Constitution, but until then, shut up and DEFEND THE CONSTITUTION WITH YOUR LIFE!

Wow, do I smell burning rubber as the contrite Congressman spins his wheels trying to throw his earlier comments into reverse! “Out of context”, eh. How about “out of office”. Now, that’s more like it!!

This is the kind of Dem who is elected by a machine (he’s a union thug to the extreme) and never raises his head because he’s stupid and scrutiny would cause him to get un-elected.

His district is D+3, he’s easily beatable.

This is my parents district. The guy Hare replaced had suffered from a medical condition for years and couldn’t even talk, let alone do the job of a congressman. When he couldn’t pull of the charade any longer, Hare got the seat handed to him.

This guy is typical of all union thugs of which he is one.
All mouth and no brains. All they can think about is clubbing the opposition.

If the mandated purchase is found to be unconstitutional, does that void the entire bill, or just those portions related to forced purchase?

Just the mandated purchase portion would be struck down.

There may be other suits later questioning portions of the insurance limitation provisions (requiring coverage for pre-existing conditions, for example) if it is found that an insurance company is operating solely within one state. No interstate commerce, no federal jurisdiction.

The rest of the bill and the reconciled changes will remain in force. Also look for a single payer system to be pushed when the mandatory purchase provisions are struck down. That, unfortunately, is constitutional, as demonstrated by Medicare and Medicaid.

No interstate commerce, no federal jurisdiction.

The supremes threw that out back in the 30s. They won't win on that one.

The Supremes, especially in the 1930s in upholding much of Roosvelt's Raw Deal, did stretch the interstate commerce clause as much as they did in finding the right to privacy in the first amendment.

But they did not find that congress can regulate anything and everything just because they want to.

They came pretty damn close to it.

Even if activity be local and though it may not be regarded as commerce, it may still, whatever its nature, be reached by Congress if it exerts a substantial economic effect on interstate commerce, and this irrespective of whether such effect is what might at some earlier time be defined as "direct" or "indirect."

Given the current court's panache for overturning stare decisis re. corporate campaign spending, perhaps Wickward v. Filburn would also be revisitied.
