JACKSON, Miss. A federal judge ruled Tuesday that a Mississippi school district violated a lesbian student's rights by refusing to allow her to bring her girlfriend to the prom, but he said he would not force the school to hold the event.

Lawsuit fail. I wonder.If a Federal judge rules that a government entity "violated the rights" of a particular individual might that pave the way for the "injured" party to sue for monetary damages?

It happens every day in America. Sovereign immunity is not absolute. You may read up on it by researching 28 USC, Chapter 171 (could be 170)

I'm sorry, I must have missed that. Did anyone deny this girl's right to associate with her girlfriend?
As I understand it, the First Amendment also guarantees freedom of speech and of the press, but does not require me to pay for someone else's platform, microphone, or ink cartridges. I don't see how the First Amendment would require her school to accommodate her and her girlfriend with a non-academic social event.

This story has read like satire but had they actually staged the thing for the sole benefit of this iconoclast attention-seeker (it has nothing to do with sexual orientation) it would have been the worst-attended prom in history.
But what a theme: “Two lesbians in an empty gym.”
