Should any Jury even allow this to come to a civilian trial?
To this end, wouldn't a way to force this back into a military trial is for the Jury to refuse to hear the case?

Bank on it, the voi dire aspect of this sham is already fixed so NO SUCH jurors will be sitting.
Wouldn’t any defense attorney with half a brain ask for a change of venue given that the courtroom is just blocks from ground zero? How in the world do they expect to get anyone in NYC who wouldn’t shout “Kill the scumbag!” during jury selection? Obama has opened a can of worms here that can only get worse and worse and worse as it develops. This is what happens when you place ideology over common sense.
Sorry, the jurists would be drowned out by the gallery shouting ‘guilty’.

The whole think is going to be a fraking sham. They’re going to end up trying Bush and not the Jihadi terrorists.
I can see it now, 2 mistrials, and then the Jihadi’s walk because the only “impartial” people they could find happen to be Arab Muslim New York cab drivers.
You’d end up with brain dead or muslims on a pre-screened panel and probably end with an acquital.
If one finds oneself on such a panel, sit there quietly, answer truthfully, but shortly and always state you could be fair.
These show trials are nothing more than the administration’s way to divert conservatives’ attention away fromt he real destructive legilsation being passed into law to end the we the people Republic. While folks are herded by the sycophantic/dutiful media into becoming outraged over the trials and hanging on every media release, the Pelosi/Reid/Obama marxist scum will institute cap&tax, obamacare, and enlist America into supporting and promoting the Copenhagen treaty. Additionally, the scuministration will allow Afghanistan to sink into a true quagmire which will be Bush’s fault and never the mooselimb sypathetic scum’s fault.
My point exactly. The defense lawyer will then declare that his client can’t get a fair trial anywhere in the US and therefore it is impossible to try him in the US. The way the Obama administration has set this up is so fundamentally wrong that even the greenest of defense attorneys would be able to tie up this trial almost indefinitely with one motion after another.
I would the the Prosecutors have some duty in screening the jury, in that case it would be better to let them go and let the CIA kill them.
I hope so, this should never come to civilian trial. The discovery will kill people.
This is going to be a sham. The defense attorneys are going to have most of the evidence thrown out because it was coerced. They're going to file motions for the US Government to produce confidential informants and to disclose intelligence gathering information.
I would be surprised if this isn't thrown out of court and the defendent ends up suing the government and buying a condo in Palm Springs.
I think this has everything to do with them trying to make a political point that the war isn’t a war and this is really a criminal enterprise that we need to fight through courts and not with the military.
The Terrorists will give a verdict on if this was a good idea or not. If they use this trial as a platform then Holder truly is a D**S***T
