Well, toc, I think your responses are on point. Ignore all the name calling. I have been here over 11 years and the birther threads are about the most contested and heavily fought ones I have seen. I still get called a troll, and worse.

There isn’t any actionable cause that I can find either,and there is a lack of any credible evidence to rebut the Hawaiian COLB. Its kinda like how civil wars are the bloodiest, so here on FR, you have brother against brother. Some peoples’ feelings are just going to get hurt.

Well, see. What you don't understand is that all 57 judges that reviewed a birther case, all the legal experts, Republican politicians, and conservative pundits that rejected birther opinions, all of them are corrupt. Even Ann Coulter.

Not Judge Carter though. He was a Marine. Unless he dismisses the case. Then he's corrupt too. Or blackmailed. Yeah, that's it.

The only good lawyers in the entire country that aren't idiots, corrupt, and have balls, are Orly (Squirrelly) Taitz and Phil (Truther) Berg.

But birthers being wrong? Unthinkable. They've done research. They read a lot of websites that say they're right!

A analogy to use here : the judge is telling Orly to wait until the cake is finished baking before you that it out of the oven.
I think, some people need to talk to her, have her sit back, think clearly, stay calm and be patient with the Judge before she make's knee jerk decisions and comments.
Orly ? we are on your side, but, stay calm, think clearly, and don't mess this case up.

Thanks for your patience with my lack of knowledge surrounding all the goings-on, but LOL...color me totally confused. I feel like I've stayed too long on the merry-go-round!

I really do hope something good comes of all of this.

No problem to fill in. I'm sure there are many people who lack the details.

One thing I did not mention that this is all pre-trial stuff. The real trial has yet to begin to hear the merits of the case. If Obama loses in his motion to dismiss, the fireworks then begin.

Nothing more than a hunch. I would love nothing more than to see the HI vital records folks have to cough up every document they've got with Zero's name on it. I am more than a little suspicious regarding the BC matter.

However, I just don't think we are ever going to see the real thing— at least not through Court action. It is just too easy for the court to defer to the legislative branch and the electoral certification system when it comes to issues of eligibility for the highest office, and I think that is what they will do. Even if a District Court issued the order, it would be appealed. Now if a STATE passed a law that in order to get on the ballot in such State you have to produce the right documents and Zero wanted on that ballot— that could be a different kettle of fish if it was Zero doing the suing to get on the ballot.

Not necessarily. The judge stayed discovery a month ago pending a decision on the motion to dismiss. I don't think that it was a sign how he was leaning one way or the other.

i.e. discovery will not be going ahead. Where is the discovery we were promised?

The Judge needs to ask just one little question - SHOW ME THE BIRTH CERTIFICATE. It could not be simpler.

My advice: forget the part about who is making which motions and how the judge ruled or will rule.

Think of it in simpler terms, without the legal machinations and definitions.

Simply: the judge wants the case to proceed in an orderly, rational fashion. In this case there is a possibility of dismissal, and there is the matter of discovery if the case goes forward.

What just happened (I think) shows that the judge is proceeding properly...he will not let the discovery process go forward until he rules on dismissal.

I know that sounds so easy, you wonder what all the fuss was about.

But if the ruling on dismissal was dragging on, instead of timely (in the view of those initiating the action), they could legally push the discovery even if knowing it won’t be allowed until the dismissal ruling, just to make a point.

Holder has already gotten to Carter, haven't you heard? He's been flying top-secret missions across the country at supersonic speeds to meet with judges at coffee shops across the street from courthouses where a bunch of Birthers are hanging out waiting for Orly because, as we all know, private phone calls aren't secure enough and could leave a trail.

No need to have discovery if the case cannot survive a motion to dismiss.

If the judge denies the MTD, I’m sure the birth certificate will be one of the documents requested. But first things first, and discovery isn’t first here.
