Dying in Vein - Is subjecting an inmate to a failed execution cruel and unusual punishment?

Can a vein save a convicted killer? It the case of Romell Broom—it might. Broom was sentenced to death for raping and murdering 14-year-old Tryna Middleton on Sept. 21, 1984. Broom isn't supposed to be alive to witness the 25th anniversary of Middleton's death—but he is. Last Tuesday, the execution team at the Southern Ohio Correctional Facility spent several hours trying unsuccessfully to find a viable vein for a lethal injection. Now, Ohio is faced with the difficult task of determining whether it can try to execute Broom a second time, after it botched the first attempt.

This is solved by making the inmate drink a 64oz. of water every four hours a day leading up to the execution.

I think the inmates dehydrate themselves knowingly to delay their own demise.

Sounds like time to dust off ‘Old Sparky’....

the only thing they’d have to worry about ‘plugging into’ is the wall socket....

This sort of question was considered in a college class I took. A prisoner experienced a failed execution in Connecticut, and tried to get further attempts stopped. The Supreme Court said that the State did not intentionally try to make the prisoner suffer “cruel and unusual” punishment. The prisoner was subsequently executed.

This was back in the 40s. What the current Supreme Court would think in such a circumstance is unknown.

There actually was a case I read in law school (I believe from the 1930s), where someone was electrocuted but didn't die from it. SCOTUS held 5-4 that it was not cruel and unusual to try again.

Execution is too complicated. A .22 slug at the base of the skull is instant death, surefire and cheap!

Yup.

The medical term for your proposal is called a “cutdown”. A little lidocaine, and the scumbag doesn’t even feel a thing. Minutes later, a patent line is running and the dirtball can be offed.

Personally, though, I’d be happy to put a bullet behind his ear.

I'd guess you're right. I have tiny veins, and was told to drink a lot of water prior to having blood drawn. I have blood drawn at least every 4-5 months, and in all the years I've been having it done, there's only been one time when they had to take it from a vein in my hand. I wonder if they even tried that option. I'd bet if I sent one of the gals from my local lab to hook him up, they'd find a vein without any problem.

They went in through my neck to get cells to donate to my sister since I don’t have real visible or easy veins. It’s painless, solves the problem and they could do it to this scumbag.
