Brothers keeping phones to selves during tiger case

Two San Jose brothers mauled by a tiger at the San Francisco Zoo on Christmas Day have refused to allow police to examine their cell phones for possible text messages or photos believed to be taken the day of a tiger's escape. In a letter sent Friday to the brothers' attorney, celebrity lawyer Mark Geragos, San Francisco City Attorney Dennis Herrera asked that Paul and Kulbir Dhaliwal preserve "this potentially critical evidence."

"The digital content of your clients' cell phones, which we understand are currently in the possession of the police, may help reconstruct what happened at the tiger exhibit and cafe," Herrera wrote.

Geragos did not return a phone call from MediaNews

Why can't the police get a search warrant to examine the phones?

It would appear they have probable cause.

The San Jose Mercury News — known by the natives here as simply the “Murky News” is known by that name for a reason...

Currently in the midst of what most citizens hope is their final death spiral -— has been getting carved up, sold off, gone through layoff and continue to bleed money and lose advertisers...

I never realized it would be so much fun to watch a bleeding heart Leftist a$$ kissing newspaper self destruct...

But then — hasn’t that been the ultimate fate of all countries and enterprises that have gone “socialist, Marxist or communist”?

I’d have a beef with a search warrant of the phones too. I think they would need to show that the phones have evidence of a crime, or were used in the commission of a crime, and BTW what crime do they think happened anyway, etc.

That said, I’ll bet a day’s pay that we eventually see a picture of one of the “youths” with a big smile on his face poking a stick between the bars, or somesuch.

I believe these punks were tormenting this animal with slingshots and are actually the real cause of the death of their friend. If the evidence shows this, I think these two ought to be tried for manslaughter.

The evidence of a crime is the slingshots these two had with them. What the h*ll do you need with slingshots at a zoo? I think they were tormenting this animal.

It doesn’t matter what the brothers did to intimidate any animals. The fact is this: The zoo is negligent because they built a structure that a dangerous animal could escape from. The boys should get the zoo and enough money to run it for a couple of years. Unless they are illegal aliens then kick them out of the country.

This one’s easy. If there’s an ongoing criminal investigation, subpoena the phones. If the photos have been deleted, charge them with destroying evidence. If they say they never existed, charge them with lying to prosecutors. Just keep nickel and diming them with ancillary charges until they agree to cooperate.

I would guess manslaughter is a possibility.

If they created the situation in which a reasonable person could assume someone could be hurt or die, then that is a crime.

A search warrant would be reasonable.

Apparently, the cops have the phones in their possession, but are blocked from examining them and their contents.
