Two San Jose brothers mauled by a tiger at the San Francisco Zoo on Christmas Day have refused to allow police to examine their cell phones for possible text messages or photos believed to be taken the day of a tiger's escape. In a letter sent Friday to the brothers' attorney, celebrity lawyer Mark Geragos, San Francisco City Attorney Dennis Herrera asked that Paul and Kulbir Dhaliwal preserve "this potentially critical evidence."
"The digital content of your clients' cell phones, which we understand are currently in the possession of the police, may help reconstruct what happened at the tiger exhibit and cafe," Herrera wrote.

I’d have a beef with a search warrant of the phones too. I think they would need to show that the phones have evidence of a crime, or were used in the commission of a crime, and BTW what crime do they think happened anyway, etc.
That said, I’ll bet a day’s pay that we eventually see a picture of one of the “youths” with a big smile on his face poking a stick between the bars, or somesuch.
I believe these punks were tormenting this animal with slingshots and are actually the real cause of the death of their friend. If the evidence shows this, I think these two ought to be tried for manslaughter.

The evidence of a crime is the slingshots these two had with them. What the h*ll do you need with slingshots at a zoo? I think they were tormenting this animal.
I remember when the Mercury News was fairly good. But that was in the late 70’s.
This one’s easy. If there’s an ongoing criminal investigation, subpoena the phones. If the photos have been deleted, charge them with destroying evidence. If they say they never existed, charge them with lying to prosecutors. Just keep nickel and diming them with ancillary charges until they agree to cooperate.

I would guess manslaughter is a possibility.
If they created the situation in which a reasonable person could assume someone could be hurt or die, then that is a crime.
A search warrant would be reasonable.

Apparently, the cops have the phones in their possession, but are blocked from examining them and their contents.
