NEW YORK (1010 WINS) -- One person is dead and two others are injured after they were hit while on a Manhattan sidewalk by a taxi that jumped a curb.
The accident was reported at about 9:45 p.m. at East 40th Street at Third Avenue.
New York City police have identified the dead man as Paul Smith, a helicopter pilot for Channel 7.
Channel 7 reports that Smith and his family were attending a birthday dinner at a restaurant when the accident happened.
The cab driver has not been charged. Police say he accidentally drove up on the sidewalk.
One person was killed and several others injured when a cab crashed into them on 3rd Avenue.
Pat Dello Iacono was celebrating his 80th birthday with Smith and his family when the accident happened.

My monies is on the cab driver being an illegal. Just because of all the cab drivers here I’ve seen.

So, no charges were filed because he inadvertently drove onto the sidewalk and ran down three people?
We recently had a thread which discussed a tragic accident at a gun range. Two cops were practicing for an upcoming test. One cop shot and killed the other. No charges were filed, and the reason was given as: "There was no criminal intent."
Probably aaplies to taxi cabs jumping the curb and mowing down people on sidewalks too.
What a crazy world.
But aren’t reckless or careless driving charges applicable?
A pilot faces the threat of losing his life every time he goes up with his chopper.
To die this way is such a waste.
