Nifong's Replacement Announced

(06/20/07 -- RALEIGH) - According to a release from Gov. Easley's office, Superior Court Judge Jim Hardin, at the request of the Governor, has agreed to fill the vacancy of Durham District Attorney Mike Nifong.

Hardin will fill the position immediately, and is expected to be off the bench for about two months.

Wednesday the state legislature gave the final green light to a bill that will give Governor Mike Easley the power to immediately remove Mike Nifong from office. The bill just needs Easley's signature.

Tuesday a superior court judge suspended Nifong after he was disbarred over the weekend for his handling of the Duke Lacrosse case.

Durham Sheriff Worth Hill went to Nifong's house and confiscated the D.A.'s access card and office keys.

It is still unclear how quickly the Governor will be able to remove Nifong from office. The state bar must first issue its disbarment order in writing.

As those events play out, there are new questions about previous cases Nifong prosecuted.

"I'm sure there will be fallout," said Attorney Lewis Cheek. "I don't have any question about that. There's been fallout over the past year."

Attorneys like Cheek know the reality of the situation. Even though Nifong is disbarred and off the job, he's made a lasting impression. Nifong's name is now a verb online in the urban dictionary.

In fact, there are three separate definitions of what it means to be "Nifonged."

The first definition is: "The railroading or harming of a person with no justifiable cause, except for one's own gain. It is someone being take n advantage of unfairly by someone without scruples or morals."

The second definition, which is more specific, is: "To be unjustly prosecuted by a politically motivated district attorney." "Nifonged is a verb that describes the railroading or harming of a person with no justifiable cause to do so, except for one's own gain. It can be used as a substitute for "screwed" and many other similar words."

So could people who have been charged with a crime, or put behind bars claim they've been Nifonged as a defense? Cheek said there would have to be some underlying contention by the defendant that something inappropriate had been done in his/her case.

For now, Cheek believes the best way to prevent this kind of situation in the future is to find a solid replacement for Nifong as soon as possible. And even though Nifong ran against Nifong for D.A. last November, Cheek said he is not at all interested in replacing him now.
