Who cares? Go to White Castle at 1 AM and you'll see plenty of drunk people eating burgers. If you can call them burgers, I guess.
I don't care how much the dude drinks. It's not like Kitt isn't fully capable of getting him home unscathed.

I did not realize eating a burger while drunk was a crime. I would think 97.9% of Americans would be behind bars if that were so.

That was pretty ugly. The icing on the cake would have been for him to hurl all over the floor.
