Larry Birkhead: 'There Was No Deal' With Stern

NASSAU, Bahamas (April 11, 2007) -

- Now that a DNA test has revealed who Dannielynn's daddy is, what's next for Larry Birkhead?

Just moments after his victory speech outside of the Bahamian courthouse, Birkhead talked to Access Hollywood's Tony Potts about the moment of truth and his plans for Dannielynn.

"What was going through your mind as they're getting ready to read [the DNA results]?" Tony asked.

"At first [the DNA expert] said my middle name," Birkhead laughed. "He said, 'The father is…' and then my middle name. And I was like wait a second, but then he corrected himself. Once he did, it was just amazing. It's this incredible feeling that all of this has been worth every ounce of energy and then some."

"So now that you've been found to be the father, when do you get to see Dannielynn? When do you get to hold her officially as her father?" Tony asked.

"Whenever I want really," Birkhead replied.

And luckily, dad didn't have to wait long to see his daughter once the results were revealed.

Access Hollywood's Tony Potts reports that not only Birkhead, but also other members of his family, spent time with Dannielynn on Tuesday night.

After months of facing off as fierce adversaries in the battle for custody over Anna Nicole's daughter, Birkhead and Howard K. Stern showed a much different side to their relationship outside the courthouse after Tuesday's hearing, as the two shared a hug after addressing reporters.

So what's behind the newfound friendship?

"[Stern] seems to have come around in the last couple of weeks," Tony told Birkhead. "People are pointing and saying there is some sort of deal going on but you've been refuting it. Do you still refute it to this day?"

"There's no deal," Birkhead insisted. "For a deal, you have to offer someone something in exchange. There's been no 'If you do this, then I will give you the baby' or anything like that. Paternity was established and there's really nothing to negotiate."

Both Birkhead and Stern have said they want it to be a seamless transition for young Dannielynn as she is handed over to her father.

In fact, Access' Tony Potts also reports Birkhead is looking for a temporary Bahamian residence where he can stay during the transition period.

"We'll have to work together to see how we can make it a smooth transition," Birkhead told Tony. "[Stern] maintains he wants to do what's best for Dannielynn."

However, the one thing Birkhead is not interested in is sharing custody of his daughter - not with Stern and not with Anna's mom Virgie Arthur.

"Virgie Arthur came out and said she was very happy to find out you were the father. Her lawyer made it sound like there's a sense joint custody could possibly happen in the Bahamas," Tony noted.

"I don't want to talk about what might happen, but I'll say that's not my intention. This is my child and I'm going to raise it," Birkhead said. "For anybody that shows they have good intentions, I don't have a problem with them playing a role in Dannielynn's life. But for someone to fight me and them come back after they lose and say they want to see the baby, that's going to be difficult for me. So if you fight me now, you might have to fight me later."

But now, the fight is over. The results are in and Birkhead is ready to begin his life with his daughter by his side.

However, there is one important question that remains.

"How many diapers have you changed in your life?" Tony joked.

"A few, but I took some classes," Birkhead laughed.

"You any good?" Tony asked.

"I'm decent," Birkhead smiled.

Tex...are you using firefox or internet explorer? I’m on firefox. Whenever I try to post stories like that my formatting gets all screwing. Are you using paragraph tags?

Yes he looks oh so sinister in this pic and she looks totally drugged and without those sunglasses looks physically abused in the face.

As soon as Howard said that Larry couldn't be the father because of TIME and claimed that he was because of TIME, Howard disavowed his claim that the birth certificate was Anna's wishes. You can't have it both ways.

Nice try Howard. What's that big "L" on your forehead?

I'm using explorer. On the articles that I post where the title of the article provides a link I use paragraph tags.

If no link is provided on the title of the article, then no paragraph tags are used (just copy and paste).

It's beginning to be noticeable that Anna drank with a straw all the time. I wonder if there were any straws in the room at the Hardrock? We know she drank tea the day before and that's a good way to disquise chloral hydrate according to one law case I saw.

Did anyone ask what Anna drank that morning?? Howard would be the only one who knew. Pretty important to get fluids into someone after a high fever and the "flu".

Think we should wait and see....but as far as I know, a US citizen can’t be forced to testify. Who knows....Howard is still playing games. That court was Dannie Lynn’s. This one is Howard’s a**.

They can go on with the inquest and he can just not testify. That would be even better in my opinion. Let all these people slam him and he won’t be able to “defend” himself.

Actually, they would the hospital would have *tried* to control her drugs. But if the truth is as Larry alleges about a previous hospital stay then Howard would have been giving Anna her drugs on the side and above what the hospital was giving her.

Date Set For Challenge of Coroners Act

After the inquest into Daniel Smith’s sudden death twice came to a grinding halt, a status hearing in the matter went off on Wednesday without a hitch, and a date has been set for Howard K. Stern to challenge the constitutionality of the Coroners Act.
Daniel, the 20-year-old son of the late Anna Nicole Smith, died of a drug overdose on September 10, 2006, while visiting his mother and newborn half-sister Dannielynn Hope at Doctors Hospital.

Mr. Stern lived with Ms. Smith and claims to be Dannielynn’s father and also claimed to love Daniel “like a brother.” He is also the executor of Ms. Smith’s estate.

Mr. Stern currently has custody of the baby, and continues to live in the Eastern Road mansion he shared with Ms. Smith before she died.

The inquest into Daniel’s death is intended to discover the legal cause of death, whether it was suicide, accident or homicide.

Senior Counsel in the Office of the Attorney General Leo Brathwaite told Chief Magistrate Roger Gomez, who is hearing the inquest, that lawyers for Mr. Stern and the Office of the Attorney General (Wayne Munroe and Bernard Turner, respectively) appeared before Supreme Court Justice John Lyons on Monday.

Mr. Brathwaite said the judge set a date of April 12 for the challenge to be heard, with skeleton submissions and Mr. Stern’s affidavit setting out the grounds on which he is challenging the constitutionality of the Coroners Act due before the judge on Thursday.

The lawyer said the parties expect the matter to be dealt with on April 12.

Once Mr. Stern’s lawyer, Anthony McKinney, had pointed out that the facts of the matter still needed to be agreed – a procedural issue – both sides agreed that the status hearing set for the April 11 ought to go forward.

At that time, the jury will be present, and the lawyers involved will confer and decide on a date for the inquest to resume.

There are 40 names on the witness list for the inquest, which Mr. Gomez has said he expects to take three to four weeks. That timeframe has been completely obliterated, as testimony has not even begun in the inquest.

In fact, two weeks after the inquest started, the only forward step taken in the proceedings is the empanelling of the seven-member jury. Immediately thereafter, Mr. Stern’s legal team brought the inquest to a screeching halt with their challenge to the constitutionality of the Coroners Act.

The act has been on the books since 1910, and was most recently amended in 1993 to set up a sole Chief Coroner and an exclusive Coroners Court.

Mr. Stern wanted the judge in the inquest to issue the jurors a questionnaire, and then allow lawyers to question jurors on their answers to the questionnaire and possibly have people bumped from the jury for cause of partiality.

None of this is possible under the Coroners Act, and according to Mr. Stern, this impossibility may impede his right to a fair trial before an impartial jury. It is on these grounds that he has challenged the act.

A successful challenge of the act may have far-reaching consequences.

Sorry for the two separate comments.

If Howard is in that court, people get a strong visual of him being in the room with Danny. The docs would know whether Anna was coherent or night and supposedly what medicine she was on OR WHAT HOWARD WAS GIVING HER per KE's instructions.

And he might have to explain his comment "He said he was sleepy....and I should have thought more about it at the time."

Well, yeh...if it was drugs....you might think of that....but at the time he said that, he wouldn't have known it was drugs.

Howard's statement says: If someone is sleepy, they might die.

But going right for the carotic artery...that was the big clue....because it's very difficult to get a pulse in a system supressed state. Guess he didn't have a mirror.

This sounds wierd court tv said HKS and his attorneys were not at the inquest hearing this morning . they ask for this hearing not even his attorneys were there not good in the eyes of the court IS THIS TRUE?

Howie and team may be afraid of getting hit with another fine for wasting the courts time.

Perhaps Howie is finding out he can't con people who he has not drugged.

His safety net is now gone bye-bye and as each day passes, his failures will become so obvious to him.

Let's see....Baby transition period....30 days

Inquest expected to take 30 days.

I don't think that Birkhead was on the witness list. But he may be now.

So if he keeps Dannie Lynn there for a month, Howard won't leave.

I heard that it was a procedural hearing, and I also heard the report that HKS attorney's did not show up.

What I didn't hear was that they had requested the hearing. Could be, but I didn't hear that part of it.
